That doesn't follow at all. They are perfectly entitled to charge for the information. The fact that they do charge for it does not imply that they have the exclusive right to do so. If someone else provides the same information, freely or otherwise, Sky should not plan to use copyright law as the basis of a successful lawsuit against them (except, as noted, that the episode descriptions might be covered). They may be able to find some other basis on which to sue, but not copyright.

As it is written, copyright does not protect raw data. It protects expression. The only fly in the ointment is that this distinction has yet to be firmly established by NZ courts, as it has been elsewhere, and until it is Sky can take advantage of the uncertainty to employ bullying tactics.

blur: Simply viewing the sky guide on-line is fine, and it is accepted that it will be cached by your web browser. However Reven's application "scalps" the content of the sky guide and stores it in xml format on a users machine. It is then changed and reproduced as an EPG without sky's permission. Remember, they own this information.

Reven also accepts donations from users of the service that he provides. Again, the use that is actually made of those donations will be immaterial if this went to court - I'm sure that Sky's lawyers will say that he has been making money by distributing data that he has no right to distribute.
