Noel Leeming Price Match is not true.

In the weekend newspaper, NL had a great big full page ad, with the captions "we will match any competitor price plus we will gives you flybuy".

Off I went to JB Hi Fi and got a written quotation on a stereo set, walk next door to NL, and I explain I wanted to buy the same item for the same price, and get the flybuy point. The salesperson looked at the quotation and type something into the computer and said all the floor stock are gone, and no they can't do it. OK. I thought I was on my way to another shopping center to buy something else anyway, so I got to the second NL store, and I said the same thing to the salesperson there. He type something into the computer and said sorry all floor stock gone, and no they can't do it. I said fine, I am happy to pay upfront and they can order one in for me, but the salesperson turns to another salesperson (more senior salesperson - I think) and ask her for help. She said the price match only applys to floor stock only. When I said this particular term is NOT stated in the fine print in the ad. she said it is, and walk off. WTH !

Noel Leeming customer service is not very good. Beware.

The following Terms & Conditions apply to the Noel Leeming Price Promise

1. The purchase must take place within 7 days of the lower price having been advertised.
2. Product must be in stock at both our store and the competitor?s store at the time of the price match
3. Product must be an exact match, including new-boxed product, make and model
4. Price Promise does not apply to any product(s) redeemed from Noel Leeming in (or in partial) satisfaction of an insurance claim or third party redemption scheme.
5. Products that are lowered in price under our Price Promise cannot be combined with any other Noel Leeming promotion (Fly Buys, bonus gifts) or competitor promotion or credit offer.
6. Standard Fly Buys points apply.
7. Price Promise applies only to regular, in-stock product offered for sale from a local retail home appliance dealer ? excludes (for example) limited quantity offers, manufacturers clearances, discontinued merchandise, stock liquidations, ex demo models, trade offers, trade-in offers, parallel imported product, ebay, trademe, private individuals, trade accounts and discounts, purchases direct from any supplier or warehouse outlet and whereby the Noel Leeming Store is unable to verify, using reasonable means, the validity of the price/quote or advertisement.
8. Internet only retailers, auction and clearance sites will be excluded.
9. All other retailer website product offers will be considered where the product is the same. 'Same product' is the same supplier, brand, make, model, year, packaging with the same inclusions and same purchase date, and whereby none of the exclusions in these terms and conditions apply.
10. Price patching cannot be used with any other promotion or installation, delivery or rebate offer.
11. Price Promise does not include typographical errors, quantity discounts, membership programme pricing or similar.
12. To be eligible for our Price Promise, you must present either an advertisement or a quote card from an eligible competitor in order for us to fulfill the promise.
13. The Noel Leeming Store reserves the right to verify the evidence of the identical product sold at a lower price.
14. If your claim qualifies for the Price Promise, the Noel Leeming store will match the price and give you Standard Fly Buys.
15. The Price Promise may be terminated or amended at any time without notice and is subject to Noel Leeming stores usual terms and conditions of trade.
16. The information customers provide the Noel Leeming store will only be used to provide the Price Promise refund to the customer or to discuss with the customer their Price Promise claim. Personal shoppers only, trade not supplied.

the terms also need to be clear in the advert as well; and I am pretty sure that "please see our web site for full terms" is not necessarily sufficient (though i could be wrong on that point)
but I thought even in their mailers they indicate that the item must be in stock, usually last page in really tiny print, but it is their.

I went to buy a 42" Panasonic TV from Noel Leeming yesterday and asked them to price match Dick Smith that was literally next door. After some fluffing around the guy came back and said they couldn't, as DSE didn't have it in stock.

So I walked out of the store, called DSE 5 minutes away, verified they had 3 in stock and went and got one.

FWIW Noel Leemings 20% off sale price was higher than the standard price at DSE. No way in hell I was going to pay it.

I went to try and buy a Navman MY30 from JB Hifi on boxing day and they had sold out. I went into Noel Leeming the next day and they price matched it after calling JB to check it was the same model. There was no drama at all.

By Trading Act NL should be able to do what it should said on the ad - so therefore they should match the price if not you can go to CAB to get some advice how to deal with such incident.......and most likely they will get sue by Comcom for false advertising
