i was just thinking in my case my mum got a lost or stolen phone upgrade from her nokia 6225 to a sanyo 5600 this was done at a telecom dealer ship they told us that telecom would lock the esn down and it could never be reconnected again. we left the nokia for couple of months then i called telecom and got it reconnected on pre pay then sold it.

so i think it can be done.

also i found a phone once that had been reported stolen so i used the contacts in the phones directory to obtain information about the owner called up said i was the owner and that i had forgoten the password telecom asked me some other Questions and i was able to get the mobile reconnected

1) If a rep 'forgets' to change to ESN status when upgrading a customer via the 'lost stolen' process, then yes you will be able to ring 123, go see a Telecom dealer etc and get it reconnected. Otherwise this is not possible.

2) That would be fraud, Telecom are generally very strict about these 'lost or stolen' passwords. Photo ID, or your date of birth should be the only way around this.

With Trade Me, or any auction site for that matter a certain amount of caveat emptor, or buyer beware is required. However in saying that it is still the legal responsibility of the seller to ensure they have accurately represented the item.

If the seller wont come to the party your next step is Disputes Tribunal

This is fraud. I wouldnt go saying too much about committing fraud in New Zealand on a public forum frequented by people working for the company concerned!

I just read the rest of your post (above), this is even more fraudulent than the first bit!

Clearly this is a case of 'recieving' stolen property, which is a crime. Recieving covers acquisition in any way of items that you could or should know are stolen. (I am not a lawyer though!).

Someone is missing that phone, it doesnt belong to you. Its stolen property.

It actually wasnt me :-( I'll bet he thinks it was though.

I am not surprised he got banned, if I ran a site like GZ I would certainly ban people who openly boasted of committing actual real definable crimes that have no moral debate about them...

You just cant run around saying things like "I got stolen property and then defrauded a company into making it work for me", and not expect repercussions.

And I find it odd that he also had what appeared to be his real name (Joe Broughton) on his profile, and previously stated he lived in Havelock and is about 15 or so. There is only one Broughton listed in the whitepages there, so its probably his address and phone number... (well, his parents anyway...)
