I'll second what nzbw says,  Telecom Retail (xtra) is totally separate from Telecom Wholesale and Chorus (as required by the government).  Retail are simply not allowed to even attempt to influence network build decisions.


Also,   April 2010 is not bad.  My area is not being cabinitised until Jan 2012.  :(

I would imagine they prioritise in order of number of customers to be affected, rather than how wealthy the area is.  10 customers is really not very many at all to talk about prioritising an upgrade in your area.

slightly OT and without knowing what area you are in.... have you checked out if any other services are available in your neighbourhood?  e.g. woosh or compass wireless, or LLU services from orcon or vodafone?

You could always donate part of your section (wait you rent?), and then pony up the cost of the cabinet, equipment, and labour to connect it to TCNZs network, not to mention consents...If you're managing to get through the 40GB in a month, it cant be performing that poorly...

I manage to get through 40gb a month, because a computer is always on with utorrent running

Yer that is really pathetic mate. They need to uprgrade your exchange. You should ring them back and say under the fair trading act I demman you supply the services you sell to me at the expected quantities for a fair price which is what you allready pay. You should say that under the fair trading act misleading or deceptive conduct is breaching the law. And you should say that they never should have sighned you up when they where clearly unable to supply you your service and that if they do not fix it you will be requesting your money back and requesting that they supply you an alternative service to that of which they advertised. You should allso claim that everyone else connected to that exchange is allso being ripped of and that they would allso be required to refund those people if such an issue eventually whent to court. It would allso attract undue and unecessary attention to telecom which would not bode well for them. And that you know your rights. And that if they continue to break the law and abuse your rights and those of their other custermous in that area that you will seek the assistance of the various organistations that exist to help protect consumers from unfair dealings.  And you should allso say that it would be better for them and you if everyone where to put this matter asside under the agreement that telecom would upgrade the exchange some time soon at a fixed date. Oh allso say that if they where to refund everyone you would insist they take compound interest and the devaluation of our currency into mind when they where forced to refund their custermors. :D good luck. Push them hard and you might suceed. You just need to make it worth their while to put a better exchange in:D

Your Giant Wall of Text is rendered ineffective by Terms & Conditions for Service.(You did read them right?) 
I think that the above is a little off the mark. The service is supplied without guarantee in terms of availability, uptime or throughput over the network (ipso-facto latency is not guaranteed either outside of the TCNZ network). If he is able to get through 40 GB of data per month (regardless of whether or not he has a torrent client running 24/7) it cannot be operating that poorly.
If the advertising states that it will 'let you download as fast as your line allows' then that is exactly what it is doing so, regardless if you are connected to a conklin or to a mini-isam. In the case of the conklin, your modem may connect at 7Mbps, but the conklin may not be capable of supplying data at that rate due to backhaul considerations, it is however, still letting the person connected to it download as fast as thier line allows.
The harsh reality of this, is that, the service carrier, cannot justifiably guarantee performance of an individual connection at the detriment of others, if they are provisioned and supplied in the same manner (of course there are exceptions, but we'll leave the government, and emergency services out of the equation, they are covered by entirely different service level agreements with a significant difference in cost).
