My s2 is dead and I'm just wondering when they did 2 years. I signed up on a 2 year term which was to expire in a couple of months.

Had hoped it would have lasted till the note 3 was available.

I have one, its called an htc-one-x and its the second biggest piece of crap. I have another 2, which are unusable which are 2 degrees smart touch silvers. Might just buy the note 2 to see me thru and get the 3 a few months after launch.

When I was working as a salesmen our warranty company pulled our mobile phone warranties for the following reason

"If a customer is on a contract with a telecommunications provider, the provider is obligated to provide that customer with a working phone for the period of the contract"

You could direct this to Telecom/Vodafone members here but that's what we were told.

My understanding from this was that if a repair falls outside of the Manufacturers warranty then it becomes telecom/Vodafone cost to fix the phone or provide you will an appropriate replacement so long as you are under term.

I bought my mother-in-law a Telecom Y300 in April and it came with a 2 year warranty..

that is an absolute load of rubbish IMO.  the contract is for the network access, not the phone.

You might very well be completely correct. I was just passing on what we were told. This is why I directed the customer to talk to Telecom and ask them.

perhaps they could do him a deal with a early resign and waive the ETCs.

This seems to indicate that telecom are commited to fixing a phone under contract.

the contract has nothing to do with it - the CGA requires that the handset must last a reasonable amount of time - and that is longer than 2 years.  They would still have to fix it whether the phone was bought on contract or bought outright.

probably.  or he was just guessing.


Here's an example that should demonstrate why it is not the case:

Some banks give you a free ipad when you sign a mortgage with them for a 25 year term.  It is ridiculous to imagine that the bank is therefore required to fix the ipad under warranty for that entire 25 year period.

I am not under contract anymore because I was on a plan that couldnt have more data added to it, and I was better served paying out the disconnection cost and using a prepay mobile data plan from another provider, but the fact it was sold with a 2 year plan means that they should have expected it to last 2 years at least I suppose.
