Hi All

 

Does anyone know if spark keep the contents of sms messages and can make them readily available under a privacy waiver to an insurance company? Or do they only store the numbers to the messages sent and the time of each sent?

 

Any help on this would be great

Yes to content but not forever I would say around 6 months and police search warrant required

So no chance of obtaining that information with a privacy waiver? As long story short I was crashed into in my car and the guy admitted fault via text and now is denying it, unfortunately I lost the texts due to accidentally delelting. I’ve tried to retrieve them with multiple tech outfits but no luck. Anyway claim is in limbo and getting the guy to sign a privacy waiver is the only way the insurance company thinks they can get the information out of him. Though I’ve researched and can only see that information being requested by a court order or police warrant?

While you can probably waive your privacy, I doubt you can waive the other party. As John has said, Police.
