WTF? Can't go into a store and purchase one outright?

I am paying $53.95 on XT Network for what's practically the equivalent to the iPhone $60 plan - and I am not in a term, so no fees to pay if I decide to move...

they tried to do that to me with the iPhone 3G too. but i just said to them im already on contract, just buying a replacement iphone. and they sold it ot me
