Since (finally) upgrading cable from 15/2 to 50/2 in Christchurch earlier this year, doing occasional speed tests over wifi at various times of day when rest of family is doing only light web browsing (no video) I have consistently seen 48-50 Mbps download - when I'm in the same room as our router. Upstairs at the far end of the house, download drops to under 20 but still sufficient for our usage; not planning to change router or get a wifi extender any time soon.

Cable profile needs to be checked and I take it the test was not done over WiFi?

always do testing over ethernet, you dont know what sort of bottlenecks wifi is adding to your network

Normally wouldnt bite, but he has a genuine complaint. And it seems the commerce commission disagrees with your view on the matter

Advertised download or upload speeds should be realistic and consistently achievable by consumers.

Arguments of "you have to pay premium" and "best effort" are not aligned with the fair trading act. Months of poor service could be considered in breach.

And now back on topic

On 120/10 - peak time fail!

Yes, he has a complaint, but "best effort service" will be specified in the T&C's he signed when he took the connection. Also (as sbiddle and several others have said) the connection is up to 100MB/s. That's the crux of the matter - up to that speed,not guaranteed (which is quite different). So, good luck with that.
I just get frustrated seeing him post his speedtest in almost every thread when John has clearly stated "there is a problem but we're working on fixing it" - like posting his speedtest results every 15 minutes will change the situation.

Same rule applies to your connection - you're not guaranteed 120 down, at all.

Cool - issue with your thinking is that you cannot opt out of the FTA. I could write any T/C's I wanted for my company, still doesnt make them more relevant or overruling than the Fair Trading Act.

They should not reflect theoretically achievable or maximum speeds as it is unlikely that customers will be able to get these speeds regularly given factors such as the customer’s distance from the exchange, the number of people using the service and the quality of the customer’s wiring.
