oxnsox: The Guy seems to admit the liability, not only by saying he knew it was expensive (because he had done some research and/or read some forums on the issue) but also by saying he wasn't fully aware and familiar with the T&C.

Soo is his issue being unaware of the T&C or the delay in the billing process?

Delays in the billing process didn't stop him using the data.... Or is that his point, that had he seen an accurate ongoing bill then he wouldn't have kept using the services??

If the guy had traveled before he would have known to watch for bill shock, and manage the data roaming. Or would have bought local sims en-route as many travelers do.

But hey if he wants to fight the dragon good on him for giving it a go.


I believe his point is that he saw a bill which he believed to be accurate and was mislead by it.  The bill lacked sufficient (or in fact any) detail that would allow him to know it was inaccurate.

johnr: Customer would of got a roaming welcome message when they turned on the phone as well


I didn't get one from NZ vodafone when I arrived in Christchurch on the weekend... and I had some real *fun* with NZ vodafone data, but I post on that in a new thread...

I'm confused, why should anyone in the remotest sense have any sympathy for that person in question? why didn't they go to the Vodafone website and find out the costs? why didn't he weigh up maybe getting a cheap sim card in the countries he visits instead of using roaming? He seems to have made a host of decisions and doesn't want to take onboard the responsibility that comes with such freedom.

You would not get a roaming Welcome message when on your home network chch is part of New Zealand

I thought South Island was overseas and treated as roaming? Laughing

One common question to the Vodafone call centre in Australia is apparently "I am going to Tasmania, do I need international roaming?"

As someone who spends way more on roaming than I care to think about (it's in the tens of thousands per year) I have sympathy for him in that roaming is way more expensive than it needs to be, for data, voice, and SMS.

However he has only himself to blame for not understanding the charges he was incurring, and trying to get out of it by going through the disputes tribunal is somewhat underhanded.

My favorite is receiving SMSs welcoming me to the country I've just left. This happens pretty regularly, especially when in Australia and New Zealand.

It looks like the judge agreed with most of what has been said on the forum but requestted further information on if getting a text saying you are using your Data Bundle could be confusing? Link http://vilain.net/blog/2010/12/94-vilain-v-vodafone-ruling.html.

One thing I disagree with is Visa statements updating immediately. My experience is they don't as it can rely on when interbank processing is done. SAomebody may correct me on this.

I'm not sure why everybody seems to confused by the 50/100MB SMS messages because it seems very clear what has happen.

It sends them when X amount of data has been billed to an account - regardless of whether this is local data or roaming data, because for all intent purposes the billing system doesn't understand the difference.

If you have a $10 100MB plan and use 50MB of data while roaming you will presumably get this message. The data isn't beind used from the 100MB plan but you've told the system to warn you when you get to 50/100MB of usage which is exactly what it's doing.

Confusing? Possibly. But it's also a measure that should prevent bill shock as users should be aware that they have used 50MB or 100MB roaming data.

well he obviously did not mean this particular part of the public
maybe the less savvy would read of his experience and think "but for the grace" but most people(i hope) would read his story and see how it could have been avoided

vodafone nz put lot pressure on retailer in nz to ONLY sale iphone to customer signs contract 12m or 24m, they will remove all iphone stock if retailer refuse to do so.

people should THINK again before signing with vodafone.

and same trick again and again, any vodafone customer can call them self as manager and promise customer to give them credit or something if thing goes wrong, but next day you call back there is no such people or the manager dont work there anymore. same trick over and over again, happen to all my friend before they left vodafone, we r now all happy with 2degree.

i've been with vodafone for more than 10 years before i moved to 2degree and i'm happy that someone finally take them to court, they should have done it long long time ago.

Like all these statements the answer is "it depends".  A Visa debit transaction will show straight away (at least with Westpac).  Also, he is right and wrong in his claim that the balance updates immediately for a normal credit card as it does for an electronic transaction but not a manual one.

Of course Vodafone wants to sell the iphone on a contract Vodafone is a business it has share holders it has staff to pay and all the other things that goes with running a business.

If Vodafone sold the iphone at RRP they would make next to nothing customers can purchase from the Apple online store if they wish!

so the guy knows charges are expensive overseas yet uses it anyway, and then tries to get out of paying a large bill by saying "it's not fair"? WTF!

Hopefully the court throws his case out on the street where it belongs.
