From SMH:

Telstra, which offers competing wireless broadband services, says that Vodafone's network infrastructure is only capable of 1.8 Mbps. Telstra wrote to Vodafone "asking they desist with the misleading advertising", a Telstra spokesman said. It claimed that the advertisements were in breach of Section 52 of the Trade Practices Act, and threatened to take legal action against Vodafone in the Federal Court. "Their network cannot provide more than 1.8 Mbps," said the Telstra spokesman. "They responded saying they were just referring to the capabilities of the modem. You certainly don't get that impression from the ads."

Apropos all the discussions here about the difference between achievable and promised speeds.
