BAHAHAHAHA! I did not realise this was bought up by MyRepublic! Of all the providers to complain about misleading advertising!

Maybe the irony was the reason the motion was not ruled as misleading ;)

There's still a Comcom investigation in progress I believe.

I think it's time we all wrote complaints to the ASA ourselves.

Interesting read. I do agree that for most people, the 'end user' experience will not be noticeably different, and also that anyone who actually cares will know enough to know the differences between the different products.

But I still think calling a cable network 'FibreX' has to be misleading. How can it not be?

Thanks for the link.

Ok, started reading - first sentence... It's an ASA (Advertising Standards Authority) complaint. I don't think those guys are technically minded and I think the thread title should be "ASA deems FibreX not misledading" because as it is sounds like the end game is here.

Funny thing is that they confirm the words can be misleading when Fibre/Cable/UFB are used but they still think overall it's not.

As someone mentioned, wait for the ComCom investigation.

Here is the main points:

Summary

35. For the reasons set out above, Vodafone submits that the Advertisements are not misleading or deceptive in breach of the Advertising Codes of Practice, as complained of by MyRepublic.
In summary:

(a) “Ultra Fast Broadband” is a descriptive terms that accurately describes the service.
(b) Vodafone does not suggest the service is part of the Government’s UFB Initiative or endorsed by the Government.
(c) The naming of the network “FibreX” accurately advises consumers that it is fibre and other technology.
(d) The relevant consumers are familiar with the HFC network.
(e) The network is an alternative to the Government’s UFB Initiative, offering equivalent speeds.
(f) The FibreX network does not suffer from the disadvantages of traditional copper networks and it is misleading to depict is as such.

Right...

Did Steven Joyce ever work for Vodafone or the ASA? The scale and audacity of the lie is about the same :-P
