Trying to unsubscribe from SMS alerts from ManageMyHealth that I accidentally signed up for from short code 5021. Replying with STOP does not appear to work. I have reported these to DIA using their normal process, as well as contacted ManageMyHealth via. email but received no response from either party. How do I get these to stop?

DIA don't seem to be doing any enforcement of the anti-spam laws but I have recently had success in using the privacy act to stop a company from sending me nuisance emails.

 

What you need to do is:

 

  • Review the organisation's privacy policy and identify an email address for privacy related queries.
  • Specifically state that you are seeking disclosure about information held about under privacy principle 6.
  • Ask for details of any consent you have provided to receive marketing materials, and any requests they have received from you to cease sending marketing material.
  • Give them a timeline which can be calculated using the tool on the privacy commissioner's web site. 

You next step will be:

 

  • If they deny that they have received a request to stop then send them proof that this is incorrect, noting that the privacy act enables you to correct any information they hold.
  • If they accept that they have received a request to stop then ask them why they have not complied as required under the unsolicited digital communications act.
  • If they do not respond within the stated timeframe then make a complaint with the privacy commissioner.

Yes I had noticed they haven't released any recent enforcement notices since 2023 (it's not 2026), and I never had any response from their either when reporting to them. Their website looks like it is 25 years old with some broken images.  Maybe the government cutbacks have led to this

Have you tried unticking "Receive MMH SMS messages" in your profile?

These are more closely described as marketing spam from MMH - they're not appointment reminders or test results, which I'd welcome actually.

 

I'd never seen that option before but have ticked it now - let's see if it works! Regardless, the unsubscribe facility not working is still wholly unacceptable.

Their latest annual report has a performance measure that indicates that they have undertaken some enforcement in relation to "censorship and unsolicited electronic messages". The problem is that those two things are combined into one figure, so it's impossible to see how much of the total actually relates to anti-spam enforcement.

 

Perhaps an OIA request is in order.
