I see that windows 10 is going to be released as a free upgrade to all windows 7 and 8.1 users. They are also stating the upgrade will include pirated versions.

Pretty bold move on their part I believe but good on them.

The big question is will is remain as a free upgrade,

The entire world is moving to "software as a service" and I would not put it past MSFT to eventually try to license windows as a $2, $5 or $10 a month service, rather than an outright purchase...

Getting everyone on Win10 for nix could be a interesting first step to this...

They have already said that they won't do this for at least the current people who are upgrading. But I can't see teh subscription model working for an OS, as apple don't charge. Their source of income will have to come from addons such as office, storage and email.

Upgrade is free for the first 12 months, has been talked about before.

All the stories I have read have not mentioned this.

My apologies , I just read one where it is now stating that the upgrade is for the first year only.

That is slightly misleading. MS have confirmed that it is free to upgrade, if you upgrade within the first 12 months of it's release, and you then get updates at no cost for the life of the OS. So it isn't a subscription for 12 months for free, and then you have to pay a subscription. You would think MS would have made it clearer when they released that statement. Otherwise my would anyone upgrade from windows 7 or 8 which gets updates for many years in the future.
