When I go into it, its telling me Im spurting 45Mbps download.


Just curious as speed net often tells me Im only getting 35Mbps.


Im about 40m from the adsl/vdsl spark locker on the street. Comes in under ground just via PVC shrouding I think. 


The only splitter I use is the one on the router. Only have one other phone port but nothing attached to it.


Just curious if windows is fibbing.

That is quite possibly the speed of the connection between your Wireless Access Point or Router and your Computer. Nothing to do with the speed between the Roadside Cabinet and your router (which is what Speedtest.net is testing).
