thecripplernz: Hey Guys

Went to file my claim yesterday but there is more information needed than notified on the Claim form, such as Apples Trading name in NZ as well as their physical address, No PO boxes allowed...

Makes things more difficult :(

I think that these are the people I need to claim against

http://www.renaissance.co.nz/index.php/component/content/

they are in charge of all Apple products within NZ. I havent spoken to these guys directly, so might give them a
call on Monday to explain the situation and give them a chance to remedy it... If not, ill see them at the Tribunal.

You need to know whether your product was sourced through Renaissance or not. There is no point filing a claim against Renaissance if the product wasn't from their distribution channel.

Most large retailers now source stock direct from Apple Australia, something that started happening around 2 years ago when Renaissance lost their exclusive Apple distribution rights in NZ.

Based upon you buying it from the online Apple store I'd pick Renaissance saying they have no involvement and that you'll have to deal with Apple.

No.  Apple is represented in NZ by "Apple Sales New Zealand Limited" (which is actually written in giant letters at the top of the invoice they emailed you too).

Their registered office is C/-level 22, Vero Centre, 48 Shortland Street, Auckland , New Zealand .  That looks to be the office of their local agent though (should be enough to serve papers of course).

graemeh:
alasta: It is a common misconception that the CGA allows you to simply approach the retailer or manufacturer and lodge a claim in order for the fault to be immediately remedied. In reality the retailer or manufacturer has no obligation to you unless you have a binding ruling from the Disputes Tribunal.

No it is not.

The CGA places an obligation on the retailer and importer/manufacturer to provide a remedy.

You sometimes need to take it to the disputes tribunal to clarify what that remedy should be.

It also states that the product should last a reasonable period of time. This is what makes the CGA difficult for consumers and retailers alike. Who is to say what a reasonable period of time is.

This is why most retailers in my experiance, unless it is pretty obvious, will wait until there is a ruling before doing any further repairs outside of their stated warranty.

Looking forward to hearing what happens.

I just took my 21.5" iMac back into Harvey Norman today, its 16mths old, so 4mths out of warranty.

Looking at "reasonable amount of time" 16mths old is nowhere near long enough.  It appears to be power supply as had technician take a look at it today and did the usual few things to diagnose.

They will be sending it to Renaissance so will look forward to seeing what is said.

Once apple received the paperwork, they called me and asked some questions, then called a few days later to offer to supply the part required. I just have to pay the labour... havent decided what to do yet...

You may get the same deal

What does filing at Disputes cost?

It may be worth taking Apple's offer there.
