So, I bought a relatively expensive pair of sport-specific shoes (Squash), from a guy. They arrived and I put them on. I was careful but in pushing my heel in, the heel of my foot hit the back of the shoe wall, and now there is a bunching of the material at the back of the top part of the heal support which I can't seem to get "uncollapsed".

 

I'd consider in a $200 pair of shoes they would be a bit more robust than this, but I am wondering if somehow I'd have a case under the CGA? I did the "damage" I can't deny that, but it could happen to anyone and seems like that part of the shoe has a design flaw that it collapsed so easily and now the foam is all bunched up with no easy way to fix it.

Depends, this "guy" that you bought them from, was he on staff in a shop? Or was he some bloke in the carpark outside the pub? CGA doesn't apply to random guys, just retailers :-)

Well he is the official importer of this brand. He has a company. He has no shop however as such.

SOunds like a design flaw to me - if you cannot put them on without stuffing up the lining, they aren't well designed/made.

 

CGA will help you, but you should give the guy a chance to remedy first before chucking the CGA book at him.

I think it's possible to put them on without damaging them, but usually when I put shoes on, I put a finger at the back to stop the back folding down and this happening, I slipped and basically put my hell on the back (Not too hard) and then it was beggered.

 

I won't be talking CGA just yet. I emailed him and he said he hasn't seen that before, and will talk to the manafacturer. 

 

To me it's a design flaw, I have other Squash shoes this isn't an issue for. I could understand repeatedly doing it may cause damage (like when your kids put their shoes on with the laces done up.

Certainly sounds a bit of an effete design for a sports shoe. Manufacturing defect I suspect.

IANAL - Does he sell the shoes through the company?  i.e. did you get a receipt?  If he sold the shoes through the company, then I would say he's a business in trade, so therefore you should be covered by CGA - (not fit for purpose).  Don't quote me on that tho.  

 

To me, even tho he has not physical shop, it would be no different to the numerous web-based PC component 'stores' out there...
