Accidents: Driver responsibilities - Community Law

It’s a serious offence to fail to stop and check whether anyone has been injured, even if it turns out no-one was in fact hurt. If you don’t have a reasonable excuse you can be jailed for up to three months or fined up to $4,500. You’ll also be automatically disqualified from driving for at least six months.

Leaving the scene of an accident when someone is injured is an offence, yes.

Leaving the scene of an accident in the no-injury case - is that actually an offence?

The immediate links and quotes of legislation provided in the links above are not clear on that point.

338 Ram Raids, robberies and smash and grabs in 90 days, if they aren't going to do something about that, what chance do you think a hit n run where someone wasn't injured has? I noticed lots of police out giving out tickets over the weekend though.

It is clear on the quoted text. How do you know there is no injury if you don't stop? Not stopping is the offence.

Fair question. On mobile. Can't search the act properly. I can see where the act defines an offense and fine in the case of injury and failing to stop. I can't see similar for the general case and no injury case.

Yesterday a car drove into me, and instead of getting out of their car to check for damage to either my car or me, they took off.

I was unable to follow due to heavy traffic at the time.

But not to worry, I have it all on my dashcam.

I've just returned from the local police station, they aren't interested.

Can I ask what advice the desk police provided to you exactly?

Complain to Ginny Anderson (MoP) she’ll sort it for you.

Yesterday, after it happened, I 105'd it to someone who finally answered after nearly an hour, so I do actually have a report number.

They told me to go to a station on Monday and hand over my video.

The person I saw this morning refused to add any information.

They said they didn't even know why the 105 team had bothered to log it.

Their words: That because it was a non-injury accident the police would not investigate it.

They don't have the time or the resources to "investigate" this sort of incident.

I said you don't have to investigate, I have the evidence, holding up my usb stick.

Still not interested, and wouldn't even take the video off the stick.

I argued for a bit, which was futile.

If I had not 105'd it yesterday, the person at the station today would not have taken my report at all.

I would not be at all surprised if it has since been deleted.

Its easier, cheaper, and more profitable to fine honest people than it is to actually solve serious crime.

Facebook it, post the video.
Give the video to your insurance company
You will soon find out who was involved

Oh, and its an election year, the last things politicians want in an election year is bad news, so go talk to the news papers and your opposition MP (ACT MP, even if you would never vote for them)

With all due respect, what kind of banana squad do you have as police? In "Brookenwood Mysteries" it always worked quite well, didn't it? 😉

Until now, I always thought that I didn't need legal protection insurance and that since I'm generally civilised and not confrontational, let the other party sue me if they think I'm in the wrong. I even once successfully defended myself in court without a lawyer, which is possible here up to the first instance, after which a lawyer is compulsory.

In the meantime, however, things have become so weird that people lie and present false witnesses against whom even righteous citizens have no chance. So I have now come to the conclusion that I should get legal protection insurance, which I had always refused before on grounds of principle, because I was of the opinion that the courts are overloaded with trivial disputes anyway.

I have just obtained quotes and will take out a policy before the worst happens in the future. What a pity! 😕
