(a) the phone is secured in a mounting fixed to the vehicle; and
(b) if the driver manipulates or looks at the phone, he or she does so infrequently and briefly.

Nice to see the Herald bothered to fact check too. They again quote that incorrect article on the NZTA website, and on top of that say the law is on the OPs side (it's not - taking a picture with your phone's camera is not one of the approved uses of a phone when stopped in abnormal traffic).

This made for quite an interesting argument with the father this morning. I hadn't told him about this ticket and he read it in the paper instead lol.

The reporter contacted me from this thread actually too, which made and interesting afternoon the other day.

What the Herald actually says is "And the law appears to be in his side".

Maybe just a way of making the story run longer. Now it can be opportunity for a story link about NZTA and the police at odds on the issue. Since most people would assume the NZTA information is correct it is a good story to tell as it develops.

If this issue has no precedent in court then maybe they have a point anyway until the story goes one way or another.

Also a good opportunity for grammar check lol. Was it in the print edition like that?

So, according to you, if I was stuck stopped in traffic for an hour or two (as I have been), or stopped for road works such as while clearing a slip and they only letting traffic run every 30 minutes, for example, (as I have been) then I would not be allowed to pick my phone up to read my ebook on it, hook it up to play some music, a game, etc to pass the time away. Nor would I be able to use the time sending an email, manage appointments, nor use mapping to work out an alternative route.

And if I wanted to make the phone call that you say I am allowed to make, then according to you I could not use the web to look up the other party's number. And even if I had their number, nor could I use the calculator on my phone to work out if I was likely to cover the distance to them in time for a meeting.

It seem to me that you are just seeing, irrationally, life and the law as it appears when written in words as being totally black and white.

And it would seem to me that NZTA is just being rational, as most of us are.

The law was an animal like a donkey at the time it was written and Steven Joyce had to arrange an amendment to allow use of GPS. Use of a camera function is just another thing they never imagined. Now that Nikon and Samsung have cameras with phone capability there'll be another law saying you're not allowed anything shiny in your hand that might confuse a Policeman.

Just having a quick think about it, smart phones these days typically arn't primarly phones, they are multi function computer, with the ability to make and receive phone calls

There's no reason that the facts and truth should get in the way of a good story.

I'm guessing the op didn't actually get a ticket ( as no address was taken initially) good to see that was clarified in the article......
