You reckon we can also take fotos of the cops talking on their cell fones?? Wait . It's been done and eather the person taking the pix has been pulled over and their car gone over with a fine tooth come or the Police have said "We were on police business" ot denied it was a cop using the fone...

They again quote that incorrect article on the NZTA website, and on top of that say the law is on the OPs side (it's not - taking a picture with your phone's camera is not one of the approved uses of a phone when stopped in abnormal traffic).

So, according to you, if I was stuck stopped in traffic for an hour or two (as I have been), or stopped for road works such as while clearing a slip and they only letting traffic run every 30 minutes, for example, (as I have been) then I would not be allowed to pick my phone up to read my ebook on it, hook it up to play some music, a game, etc to pass the time away. Nor would I be able to use the time sending an email, manage appointments, nor use mapping to work out an alternative route.

And if I wanted to make the phone call that you say I am allowed to make, then according to you I could not use the web to look up the other party's number. And even if I had their number, nor could I use the calculator on my phone to work out if I was likely to cover the distance to them in time for a meeting.

It seem to me that you are just seeing, irrationally, life and the law as it appears when written in words as being totally black and white.

And it would seem to me that NZTA is just being rational, as most of us are.

Nice strawman. Actually, the law says that no, you can't read an ebook. And no, you can't use the phone to look up the number on the internet. No you can't use it to play a game. Nor could you use it to manage appointments or look for an alternate route.

And no it's not "according to me". It's according to the LAW. And the law is actually as it appears written in black and white.

Except when you are not in the phone application on the device, are you really using a phone? Thats like saying you are using a screwdriver when you have the plyer out on a leatherman.

Do Auckland council staff/Auckland transport count as well?

One News successfully took a video of an Auckland Transport employee driving a Auckland Transport branded car using her mobile while indicating. When confronted about her use of her mobile while driving she said that they weren't allowed to film her. Didn't stop them broadcasting it though.

It seems that following the law or using public transport is for other people.

So.. an iPod Touch is ok (As its not a Phone) to take a photo with and an iPhone isn't even if they have the same capability? (And even looks like one to a lot of people)

You can eat a triplecheese burger with both hands while playing with a nintendo, thats probably ok if you dont cause a crash

LOL at your logic here... What you proposing is Driver Distraction. You dont get behind the wheel if you going to be distracted.

What you are saying is that this law is according to YOUR interpretation black and white. You are therefore claiming that everything to do with the law, either directly or indirectly, is contained within your knowledge with no matter whatsoever that may need consideration in its application being at large, including what the original intentions of parliament were and how accurately they were interpreted by the administering Govenrment department, and that you are therefore right.

Quite a big claim; well in my view anyway. Things are infrequently that clear cut, just a simple example being that that it is not unusual for two parties to go to court (including the police prosecuting) both believing the law is black and white and on their side so they will surely win, but one party (or sometimes both) finds out that they were mistaken.

And sometimes the law even turns out to be of poor sense (or even stupid) for reasons of poor drafting, becoming archaic (which in, for example, technology matters may occur within months), unanticipated consequences, etc and is treated as being such.

EDIT: Meant to mention that you need to familiarise yourself with the correct usage of "straw man", as the giving of examples that appear to contradict another's argument does not count.

If it hasn't been sent yet then I would think the chances of it having been sensibly consigned to waste of time bin are pretty high
