+1 and I thought it was someone that had been 'run over' as usually thats what the term "hit and run" means (well it used to a few years back).

mr uninsured or mr van driver ?

mr van driver would still be in trouble for fleeing the accident ?

Van driver. Other guy is in trouble as he was at fault most likely and wasn't insured.
