I don't have much sympathy for him. I don't think he is a particularly sympathetic character, though he did have some amusement value for awhile.

 

He has certainly had his day in court and I think he has been very fairly treated by the judicial process. But I also think he was shamefully treated by the authorities. The manner of his arrest was a bad joke by monkeys in uniform tripping over themselves to impress the Americans, who attempted to railroad him in order to make an example of him to please Hollywood. The whole episode was and is a travesty of justice.

 

Dotcom is a legal resident of New Zealand. His company was located here for at least part of its existence. He should have been arrested and tried under New Zealand law and, if found guilty, sentenced in New Zealand. Otherwise the whole sorry episode should be brought to an end.

 

Dotcom is not being prosecuted for what he did, but for who he is and what he represents. You don't have to like him to be disgusted by this.

NZ and most western countries have a cultural dislike of Germany stemming from the world wars (and WW2 in particular), which isn't helped by Hollywood perpetually portraying bad guys as Germans.  I don't know about others but I can still remember the absolute rabid dislike one of my grandfathers had for 'the hun'.

I gather that under our extradition treaty, someone must have a case to answer for that based on our own laws would result in a prison term of x period. Given that there is no prison sentence for copyright infringement in NZ, then he can't be extradited for that purpose.

 

They have had to rely on the money laundering / racketeering charges for the purposes of the extradition. Guilt / innocence of the charges it to be decided in a US court, but our judges were obviously of the opinion he had a case to answer.

 

There are still the possibilities of the Court of Appeal or the Supreme Court if there are grounds for appeal (IE a judge has incorrectly applied elements of the law and/or precedent set by a binding authority) but as far as I know, if the high court has done everything right, then neither the court of appeal or supreme court are obligated to hear the case.

 

Agree, until his fat arse is actually on a plane and its in the air, Elvis has not yet left the building.....

 

 

Without reading the rest of the thread, thats where it sits for me. While its naughty/bad etc for feeding torrents and whatever, he's made a few quid, and as alternative downloaders will know, there is no need to pay for it.

Don't get too excited. This will still hit the Court of Appeal (probably from both sides, as the crown lost fairly majorly in some ways ) and then the Supreme Court.

 

Whether you like him personally or not, there is just simply no way he should be extradited, and if the case does eventually go against him, it will be a travesty. 

 

 

 

 

 

 

 

 

Has he hosted a few episodes of The Bachelor, or has he been into it bigly? It may depend if your into free everything, or the legal system. Or perhaps into the legal system until you want free?

The bottom line is you cannot rip off ownership, even though many may say its ok.

Indeed, so the providers of OneDrive, Dropbox, iCloud, Google Drive and any other cloud storage service are now on notice that they could be personally arrested/have their lives destroyed if any users of their system ever store copyrighted materials there.

Users of these services should brace for the fee increases that will be passed down once the copyright owners get around to all these guys with the whole "Lovely cloud service you got 'ere, guvna, innit? Shame about that Kim Dotcom guy. 'Aate for that to 'appen to you too, guvna."

 

 

 

No. If you or I hosted a legit service and it was found to have illegal content, we might get told off, told to tighten our business. The law isn't unfair. If we were found to have used the "legit" business to intentionally harbour illegal content for gain, well, bets are off. That how I see it. If anyone thinks KDC was not in it for gain from intentionally hosting copyright content, they are dreaming.

It's interesting that when people talk about copyright breaches, it is almost always only films and music that get mentioned. Art, photography, writing etc never do.

Oh please, only people who go out of their way not to break the law get the unskippable warnings and advertisements included before the movie for your additional viewing pleasure. Filthy pirates get none of that amazing bonus content, and they have to choose which one of any of their devices (and how) they will use to consume it. Proper consumers have all those difficult choices managed by someone else for them. I can't imagine why anyone would be motivated to consciously choose to miss out.

Oh no, the photography companies have their own lawyers too. Of course, the movie people would never do something like that, because piracy is theft.

Sure - but you can soon persuade a firm of lawyers to go after a target like Getty.

 

What about the thousands of individuals who produce images daily that are stolen? No one bats an eyelid there. As someone once said, if you put it on the internet, you're giving it away!
