Interesting comment though that "copyright infringement is not a criminal offense in NZ". Seems "copyright is theft" is fundamentally wrong based on the High Court decision....

Very interesting but I will believe it when I actually see him sitting on the plane.

Does this judgement leave any wriggle room at all, or is it finally the end of the road? The finding that copyright infringement can't be used to extradite him seems a little perplexing.

I gather that under our extradition treaty, someone must have a case to answer for that based on our own laws would result in a prison term of x period. Given that there is no prison sentence for copyright infringement in NZ, then he can't be extradited for that purpose.

They have had to rely on the money laundering / racketeering charges for the purposes of the extradition. Guilt / innocence of the charges it to be decided in a US court, but our judges were obviously of the opinion he had a case to answer.

There are still the possibilities of the Court of Appeal or the Supreme Court if there are grounds for appeal (IE a judge has incorrectly applied elements of the law and/or precedent set by a binding authority) but as far as I know, if the high court has done everything right, then neither the court of appeal or supreme court are obligated to hear the case.

Agree, until his fat arse is actually on a plane and its in the air, Elvis has not yet left the building.....

Don't get too excited. This will still hit the Court of Appeal (probably from both sides, as the crown lost fairly majorly in some ways ) and then the Supreme Court.

Whether you like him personally or not, there is just simply no way he should be extradited, and if the case does eventually go against him, it will be a travesty.

What does seem clear is that you can be done for fraud if you profit from it in any way.

Indeed, so the providers of OneDrive, Dropbox, iCloud, Google Drive and any other cloud storage service are now on notice that they could be personally arrested/have their lives destroyed if any users of their system ever store copyrighted materials there.

Users of these services should brace for the fee increases that will be passed down once the copyright owners get around to all these guys with the whole "Lovely cloud service you got 'ere, guvna, innit? Shame about that Kim Dotcom guy. 'Aate for that to 'appen to you too, guvna."

Except the large German had a service that was designed specifically to enable and encourage people to breach copyright and seek profit from doing so. The whole payment/fee structure was designed to encourage copyright breach. Also, when told to remove offending material, this wasn't done; rather just a specific link to the material was removed.

The sooner he is deported and tried, the better. Anyone who goes to a country and tries to subvert their political system, and chants obscenities about the democratically elected leader, should expect no sympathy. And that's leaving aside the fact that he failed to disclose his criminal convictions when applying for residency.

I guess there is a lot of hate against KDC here. I'm not quite sure why. It all seems rather right-wing and reactionary to me. Kind of like - "lets all laugh at the fat man".

As for this whole business of sending people to face charges in a jurisdiction that they have never visited - I find that scary. As an early poster pointed out - maybe DropBox, One Cloud, Youtube et al are now worried but somehow I don't think so. One of KDC's problems is that he has never contributed to any US political party.

As far as I am aware, copyright infringement is still a civil matter in this country and should not be a reason for extradition. Hence the trumped up money laundering charges to try and come up with something that falls within the bounds of the extradition treaty.

I understand that KDC had his servers located in a US facility. Is that grounds for extradition?

Lets face it - he got up the noses of the various **AA US organisations (who *are* major political contributors in the US) and of course our cops really did want to play with guns and helicopters at dawn.

I think the whole sorry affair is a terrible indictment of how NZ kowtows to the US and their "best government money can buy" political philosophy. Certainly not a system I want to see in this country.

He's hardly the only person who said "F*ck John Key", or the only rich guy who has started their own political party when they were unhappy about events transpiring them around me. I'm a bit conflicted around the conviction thing, it wasn't one of his foreign convictions (he disclosed those as required) but was a dangerous driving charge for doing 150 in a 50 zone in NZ. It's bad that he didn't declare it, but I'd be very surprised if a driving charge was grounds for refusing residency.
