Take a look at the comments on the auction (http://www.trademe.co.nz/Browse/Listing.aspx?id=224920433)

especially the one which says - "how many do you need? check us on dolche dot com" and "This is brand new and it is 147.00 on the cheapest website in nz"

"Complain" to trademe and get him blocked for plugging his shop details, easy. the username name rings a bell for some reason.

his stuff all seems to be very much at the high end of the pricing scale anyway. $4.50 + $7 post to for 100 Grams of chocolate coated coffee beans is utterly ridiculous!

Point out that the 'Brand New' tickbox option on Trademe specifically states "Brand new, unused item with original manuals and packaging"

ahh yes a very good point, I'm quite careful with my stuff and until about 6 months old, I can usually state "brand new" but I don't.

I state in "near-new condition" a big difference and reflect that in the pricing..

That router wasn't even cheap and certainly not for something that had been used..

In the questions on your auction it gives the vendors website. Do a whois search and then go to www.companies.govt.nz and search company. It will give you director details. Then try whitepages on interweb and you'll probably get a phone number. Talk to them. It's quicker than email and more forceful.

I've checked out that site and his other site, customer testimonial are actually his other businesses.

Anyway, I've reported to Trademe, but they only says that if it's not settle then I should take him to dispute tribunal. I'll just have to wait for the refund, wonder when it will be.

Although phone call is good but email, you have everything in written. Harder to twist around than words especially if you can't do 2-way record on your phone.

Got the refund in full and inclusive, edit the comment, although still have an unhappy face there. And put in the part about "Brand New" as pointed out my Adamal. Thanks for that.

Today, I've received an email from Beatman asking me to change my comment on his feedback, email message as followed,

"As a comment we all sell items that is been left from a sale or we get them at seconds. Nobody can make a living in selling brand new items at cost. You did get it at cost so what do you expect. It is brand new and has only been taken out of the box for a customer looking at it.

Looking forward to your change and comments."

I then had a look at the comment I gave him -
"Good communication but I purchased a brand new but got an ex demo. Trademe states "the 'Brand New' tickbox option on Trademe specifically states "Brand new, unused item with original manuals and packaging". Auction rule is you are not to mislead your bidder. Anyway I got my refund but waste a lot of time and good feeling. *** Warning for future buyer. *** "

He has respond to my comment as
"As a comment we all sell items that is been left from a sale, surplus stock or we get them at seconds. New Items you have to sell at a profit otherwise you crazy. Nobody can make a living in selling brand new items at cost. You did get it at COST so what do you expect. It is brand new and has only been taken out of the box for a customer looking at it. Full Warranty on the product."

The router clearly isn't just opened to show customer, it's been used. The power plug guard was removed. It seems he hasn't got the point of different between "Ex Demo" and "Brand New" nor feel guilty of which he has done.

I believe the appropriate response would be 'Sod off' and leave it at that, at least you have your money back.

Yep. Got your money back? Leave the feedback as it is, because it's true. His reply just helps to show the kind of operation they are running. And don't buy from this seller again.

It's TradeMe - I don't think it's unreasonable to find new items listed below cost.. often people will sell unwanted brand new items (gifts/promos/giveaways/etc.) just to get rid of them/get something for them.

He's totally in the wrong.

What a rooster. Contact Trademe. He's plainly stated in his feedback that it wasn't as per the 'Brand New' requirements and will be able to confirm on his auction that he used the 'Brand New' option.

I've done that. I've also sent copies of my email correspondence with beatman and print copy of the auctions to Trademe.
