A week ago I won an auction on Trademe for New Linksys Wireless Router N Rangeplus for $145.00 (reserve met). When I got the goods this morning, it wasn't new, the box wasn't seal, no plastic wrap, the items are on in plastic bag nor bubble wrap. The document and CD part was opened and torn.

I email the seller quickly asking for explaination, and the reply I got was

"It has been checked and opened up. We demonstrated to customer that cancelled after.

It is brand new."

For me that is an ex demo not NEW as mentioned in Auction. I told seller that the item is going to be given as a present so I really a new one. And this is the respond from seller:

"Sorry ? it is brand new. See what you can do to make it look ok.

I have a sealer here for plastic wrapping."

I then request for a NEW one to be sent and I will send this ex demo one back. (I left exactly the same message as in email on his feedback). The reply was:

"Can do mate, you will have to pay extra for it then. You got a bargen.

RRP (ex. GST) RRP (inc. GST)
177.73 199.95

Send the one back now and I get you another one.

You paid $145.00
New one is 199.00
Difference is $54.00

I will let you know when it is ready for you to pay the difference."

And followed by
"By the way let me know very quickly as I have other watchers interested in the product."

Neg feedback him straight away and complain/request refund via normal process. It's just not on.

Negative feedback and report it, and let us know trader's nickname so we can avoid them?

I had similar issue with a seller.... advertised item as being brand new - when it turned up it was obviously ex-demo but the price I got it at ($30 IIRC - retail is more like $150+) I couldnt complain :)

But in your case, yeah its pretty cheeky of them to ask you for more money.

Go to TM and complain of false advertising.

I wasn't sure at first if it was the traders name, or some new lingo that the kids are using to describe misleading people these days. But hey, it worked.

Had a friend helped with writing a strong letter to him, apparently he will refund when he got the Router back. So I put it on overnight courier with Track & Trace. We request the refund in full include shipping cost.

Still have to find out whether he will do that or not. Or what other trick he got in his sleeve.

I don't think there's anything wrong with it selling it as new, BUT he should have specified clearly in the description that it had been opened and checked prior to listing. If he didn't specify that then he sure has heck shouldn't be expecting you to outlay a whole lot of extra cash or telling you to 'see what you can do to make it look ok'!

I don't know, seems you've lost out all round by sending it back at your cost, and you still don't have a router you bought in good faith.

NickiB, I wouldn't make a big fuzz if he mentioned it in the description if it was Ex Demo or As New. All it was, the headline with "New Icon picture" and equipment description, nothing saying about having been opened.


And in one of the questions asked by other users during the Auction period:
Question: I really need this router! $60? Has it been used? [Trademe User] 6:31 pm, Mon 22 Jun
Answer: This is brand new and it is 147.00 on the cheapest website in nz. You may like to review your offer. 9:49 am, Tue 23 Jun

Courier track & trace delivered, signed received. I printed the report page out into a PDF format and email it to him. And I'll be checking my account regularly.
