Oh and PS if you do end up getting it working and keeping it, don't what ever you do restore it to vista. It'll periodically lose its sound card and cd drive without warning even though they the hardware bench tests as working fine. Another wonderful little lemony surprise they throw up and theres NO fix for that!

On Win 7 they work absolutely fine and are a good laptop.

2. Contact Trade Me and tell them you suspect there's pirated software involved

i would do this.
also ask for refund and tell them you're going to make a police report on pirated software.
then make a trademe complaint for pirated software

can't tell them that now because they blocked me on tradme and also on the e-mail address.

not sure how to do the police report thing.

if i go to the disputes tribunal does that mean i have to travel up to Auckland where he lives?.
if that's true it's going to cost a lot of money to fight it.

No, if you live in different cities then the case will be held either in your city or his and the other person will be conferenced in via telephone.

Ok, so this is a case to get in touch with Trademe. Make them aware of what the trader has done and that you will be raising it with the Police and/or Disputes Tribunal.

I don't think they can provide the sellers details directly (maybe because of the privacy act) so the police and/or disputes tribunal will need to make contact directly with Trademe. Someone else who has been through this process might know more.

Go on the Trademe community board, post your story up there :) I reckon you'll see a lot of questions on all their auctions within a few minutes and maybe a surprise email from the seller.

The only real problem with that is, that Community Watch isn't available after the auction has closed :S
Have Trademe replied yet? They are usually quite fast(under 24 hours). Also not sure if you can use Community Watch on any of their future listings, since they have "blacklisted" you, meaning you can't comment on any future auctions of theirs

As long as you just post the facts and don't put the trader down in anyway, and ask other peoples opinions, you should be fine. The trader looks interesting, as it looks like they trade in furniture and computers.

The traders feedback is not too bad. Perhaps they will remedy this.

Can you remove the neg. feedback? You should not have placed that until this is resolved.

Assuming you cannot fix the laptop.

I'd document the laptop condition completely. Photos, try to get the software details if possible etc. Record serials etc.

Send it back at your cost. It is the only way you can move forward. The risk is you lose your postage costs, if this trader is truly a rogue.

Sure, the trader will have your money and the laptop, but a non-working laptop is worth nothing.

Try to get a refund , or the laptop posted back to you in fixed working condition.

If it is not resolved , you must go to trade me to see if they can resolve. Otherwise, disputes tribunal .

Thats what I'd do.

yes trademe e-mailed back and said to request a refund if not then i should post the feed back on the seller.
and that they would take action if it was needed. if i still didn't get my money back after that i should take him to court.

it;s not miuch help to you now, but this is why I never buy expensive goods from outside my location. Cheap stuff I can afford to lose out on if necessary, but for this kind of $ I wouldn't consider anything I couldn't pick up.

hey guys just thought i would give yous an update on how im going with this case.

i have went online to trade me and printed off the form to request the sellers details. i filled that in today and got it sent off to trade me in the post (fast post) i have an appointment with the community law center on Wednesday. it turns out that trade me will release the details to me but i had to legally swear would only use the details to take him to the disputes tribunal.
i got the print out of the transaction
and all the pages off trade me pertaining to what happened
the e-mail records

so things are underway wish me luck. thank you everyone for your help and support you have given me so far.

now i just have to stay positive

Good luck with your case.

If you do get as far as the Disputes Tribunal make sure you have all your ducks in a row. Make notes in your dairy on everything that happened/s on the date it happens and print off and take along all correspondence. Also brush up on the relevant points of law (Community Law Center will help you there).

I was reading this thread when it started, i didnt post a reply though.. Funnily enough a machine came into the shop with the exact same problem, i was like hmmmm. Low and behold its the same laptop

.

Meanwhile, for everyone else curious, the motherboard is toast, well known fault in this line of notebooks, along with the dv5000 and dv6000 series, they offered an extended warranty on these models but that time has passed too.
Very strange that it worked for you the first time however! It must have been on its way out and he knew it, so sold it before it completely died.
