I too suggest you keep nagging for a refund and also a removal of the negative feedback as it does state that if you feel you have received unjustified negative feedback you can put through a request for them to consider removing it.
On the refund side they should give you if you mutually agree not to go through with the trade as chances are your going to relist and why should get paid twice for the same auction.
I have found when dealing with TM over dodgy auctions or when they remove a listing they don't care whether they're right or wrong as they have the power. They once removed auctions I had listed for (dare i say it) Hannah Montana merchandise bought in the USA as they had supposedly received complaints the items were fake and they wanted me to provide evidence to prove they were not fakes. Luckily for me we still had the receipts for the items (bought from Target I think) so sent them through. They simply said that we could relist them again if we wanted no apology or anything like that.
Happened also with DVD's we were selling they used the good old where's the NZ classification sticker to show it has been okayed by NZ law to be screened / sold within NZ. I wrote back with about 20 auction numbers of other people selling unclassified dvd's etc but they didn't care and refused to let us sell them. Strangely enough (yes this is sarcasm) they didn't remove a single one of the auctions I had sent through to them with the exact same breach of their T's and C's.
It really sucks there's is no true competition in NZ it's pretty much TM or nowhere as most the other sites are so tiny they don't stay around long or they just aren't known to a lot of people.
Of course though in saying all that when it's working well most people won't say a thing but soon as there's a problem you'll normally find a lot of others have had similar issues. That's why i no longer play home doctor and look up symptoms for illness online anymore reading medical forums is always grim hehe.
