I had a trademe listing that was won by someone and now they cant go through with it.

I fully understand their problem and don't want to go ahead with the sale for their sake either.

I realise I can relist it as it wasn't sold and claim back my success fees, but does that leave negative marks on the buyer or can I make sure they don't get any negative feedback or anything?

How would I do this so the buyer isn't given any negative connotations as their positive feedback is very important to them?

If you claim your fees back it will just go down on their feedback as the buyer won the auction but it was not completed. You can then go back and comment on this feedback I think.

I recently did similar but opposite. 250 odd trades with a perfect feedback record. Guy asks no questions on the auction, bids and wins my item. Then starts asking about warranties etc and pulls out. I give bad feedback and then he does that to me, saying I tried to force him to buy it? Mighty annoyed about the whole thing as I did nothing wrong.

Any how, there are plenty of opportunities to comment on feedback or auctions that weren't completed etc. I've done this in the past with buyers and we've both come away with little smiley faces.

There is probably not much you can do, if you want to get the commission back from trademe. Legally they were required to follow through. If the buyer just reimbursed the commission that you paid to trademe, then you don't need to apply for a refund from trademe, and can bothpost positive feedback,  and then you can relist or sell a 'similar ' item.

The thing about feedback, is that it is not a badge of honour, even the best traders can get negative feedback, so it shouldn't be taken personally. Buyers don't care if there is the odd bit of bad feedback about a seller. The problem is if there a trend / high percentage of negative feedback.

I'm pretty sure there is a Trade Me rule against this type of retaliatory feedback.  Check out the help on TM for details (I'm too lazy :)).

If the feedback breaches the TM rules you can get it removed.  I've had this done, you just need to ask through their help system.

I guess I was lucky, I got mine done under the rule "The trader placing feedback has been permanently removed from Trade Me for misbehaving" :)

Thanks, I wasn't actually aware of that. I might try to get mine removed, as I didn't initially state any clause that the trader had breached. However it may be too late now. I have only one negative feedback placed about me, which was retaliatory.

if you choose immediate refund then you dont get the blue kiwis on feedback, if you choose to email the buyer then you sometimes do IME.

I had this recently when a buyer failed to make contact after two weeks. TM told me to leave negative feedback and move on. Of course the buyer then did the same to me.

He then sent abusive emails, phone calls and texts, he even found me on Facebook and sent me abusive messages through there. I complained to TM who said there was nothing they could do and I should call the Police !!

I told them that wasnt good enough and complained via the website every day until they finally called me.

They agreed it wasnt my fault (a problem with his Xtra email account meant all of mine were going into his spam folder) and with the agreement of the buyer TM agreed to remove all the feedback for both of us.

My advice is to not take the first answer from TM (they dont really care once they have their fee) and keep sending in complaints until you get the outcome you want.

Ive spent years on Ebay where bad feedback really counts against you and I want to keep my 100% feedback on TM. Why should you accept bad feedback when youve done nothing wrong ?

I wish more people would fight to keep bad feedback from being posted and I wish TM would take it more seriously.

I have tried to get mine removed again, but they say that retaliation feedback isn't a breach of their terms, so they won't remove it. Therefore their code of conduct must be separate from their terms and conditions.

Keep complaining.

I think I sent half a dozen before they got fed up and agreed to remove it if we both contacted support@trademe.co.nz to give our respective permissions.

I don't want to Pee them off, and at the end of the day they can do what they want within the law. However I do want them to be fair and consistent with their policies.
