It may however be difficult/time consuming to prove when exactly it went into receivership, and exactly when the order was placed. If they haven't received the goods they paid for, then it is simple, they should issue a chargeback, but give the company warning that if they aren't refunded within a few days a chargeback will be requested. Don't the company have to pay extra when their customer makes a chargeback?

It's not difficult at all, you just go to the companies office website http://www.business.govt.nz/companies/app/ui/pages/companies/1832748

The receiver was appointed 4/11/10.

I know BNZ provide some sort of guarantee that if you order stuff off the web and it doesn't arrive they will reverse the charge.  Presumably most of the other banks do something similar so as long as you can demonstrate you have tried to sort it out they will refund the charges.

The receiver's first report was posted today on the companies office website for those that are curious.

It looks like Hubsta will be liquidated by the High Court on 17/11.

In the report it says they have organised refunds for all orders placed after 4/11 where people have not received the goods so a refund or the goods should arrive soon.

I tracked down the receiver for a mate at shark patrol - they seem to access the companies office info mentioned below.

Tried http://www.thedeal.co.nz/ today and it is back up and running. Are they trying to trade themselves out of receivership?

Oh I see what you mean. I thought I'd done or tried to do something naughty -whew!

Just an update, I was able to contact the receiver, Lance Gilbertson, who was a quite polite and helpful chap, he told me that refunds were being processed, sent me a copy of the receivers report, and a couple of days later I got an email from "The Deal" saying that they had to cancel my order due to issues with their supplier (no mention of receivership) and that they were refunding me, and a couple of days later I had the money back.

I don't see why they couldn't just be straight up about being in receivership. The website is still running and seems to be getting updated, all seems rather odd.

Hey great to hear that you got your money back - I bet you are relieved about that.

The receiver / liquidator probably hopes to on sell it as a going (viable) concern, like they did with VoucherMate - they went belly up a earlier this year (or late last). The new owner tweaked the model and now one assumes there's money in the bank.

i just got email from them advertising "Great savings on Scanpan & Kitchenware". Maybe they still have some stocks of some items they're trying to clear, or some deals that are still active

i see that the yahooxtra shopping site, which was the same back end as thedeal, is showing the hubsta receivership notice and says site closed.
