Leximus:
After if someone won the item at reserve, the TM program shouldn't be give me or anyone an option to incrase or negotiate on the "won" price, but its did. If someone won an item and reach the reserve price already, dont give a chance to change anything on that item, isn't that? But thats happaned with me!

You can list an item at $1 with a much higher reserve. I suggest you go find out.

jeffnz: well only getting one side of story here but on face of it they are able to do this and have whether people think its fair or not. Personally I would be miffed if I bought something fair and square and seller decided it wasn't enough.

When you say "little argument with admin "how little was it?

Wasn't a big argument, just talked what i shouldn't do, the buyer made the whole situation bigger than was it. She could have lieve with a negative feedback, but wasn't enough for her.

Credit to you for actually responding again after the total agreement of everyone else that you were totally in the wrong... But... What you did was a most unbelievably basic wrong. "Auction" and "reserve" are _very_ simple concepts and in fact are central to Trademe and your situation. You seemed at the time to not understand what a reserve price actually meant, or how an auction works.

You also mentioned at some point that in your second account you had 20 positives and 3 negatives? That's still too high a proportion of negative feedback.

Cheers - N

Actually fair enough, if I won the auction for a 1$ then someone backed out or tried to change the price, I would be annoyed and want them banned as well.

BraaiGuy: OK I will like to throw a spanner in the works here...

Sure Leximus is in the wrong. And sure a ban would probably be waranted. But is this not too harsh from TradeMe?

Remember Leximus was the seller in this case. The person who bid on his $1 is not exactly at a loss. Hence I do not see the big deal, Leximus received his bad feedback which was waranted? And thats what the rating system is for is it not?

There are many people trading on trademe, people selling from china/etc and even delivering from China, and probably not even based in the country. I have highlighted such a seller to TM, wh sent me a fake kindle cover, advertised as geniun and new from Auckland. It arrived fake and from Hong Kong. The seller continues to trade and my item Kindle cover made the bin. $30 loss.

?

The buyer could have suffered a loss though, as now they will have to pay more if they want that product. So it is a cash loss.
But I don't understand how the seller was given the option to negotiate, as the buyer and seller should ahve received an email at hte auction end to say it had been sold, and the bank details. Perhaps it's a bug, or maybe it wasn't a $1 reserve auction, but a $1 start, and the price never reached the reserve. Something strange happened.

No my first account has 20-25 positive and only with this situation I had 3 negatives, with my second account was only 10-15 positive. So I tried to prove them I can be better but they did not give me a chance...
And you right, i did not know that part of the trademe, I was only using ebay earlier, that was much simplier to use, but again I only purchased products from ebay too.
Thanks

The problem is that by creating a second account in the first place, you actually proved to Trademe that you can not, in fact, do better - creating that account violated the Trademe Terms of Service, which state you may only have one account (banned or otherwise).  Proving that you can abide by the ToS by violating it is hardly making a good impression.  It's not surprising they banned you.

What you should have done is contact them, explain the situation and ask if they're willing to let you use the site again.  If they aren't, well, Trademe is a privilege not a right and it's their ball and court - you have no automatic entitlement to use their site.  But if they are, then you get to use the site free and clear.  Unfortunately, the chance they'll look favourably on such a request from you now is pretty much zero.

The buyer did not loose any money, just did not get the item, was actually ps2 games, but I think you right, was could be a bug, because after won, the program offered for me a chance to incrase the price If I want to. I tried to tell to TM on that time, but they only care my fault of course.
Look, happened long time ago, I can't remember every details, but defenetelly was a chance for me. If I don't have a chance to think I can change anything, I won't do it.
I know what you think, ether way you shouldn't, you right!

Thanks for the advise! I tried already ask them to keep the second account, doesn't work.
The TM Terms of service doesn't say you can not create another account never!
thanks anyway

Yes, I was wrong I made a bad think, I know!
But just think about the program!
If I or anyone on the world doesn't know about web sites, programs or anything, do you think about how to create a website to be good for dummies?
If someone create a program, think about bugs as well, so everyone can use without this kind of situations.
Thats for everyone who said I was wrong, I know I was.
Just one more thought!
If I give you my money, and say nothing what you can use for, and you spend for anything you like, can I blame you, you did wrong, you spent for something I did not want? TM gave me an option to do whatever I want, I did.
Thats what did on TM, No offence! Don't missunderstand me!

Thanks

If i was a trademe staffer and i saw a person who had a banned account then go and create a new one, and still had a 13% (20:3) negative feedback, i would be thinking there is simply something fishy about this trader.

There is nothing in NZ law that says you have a legal right to use trademe and they can refuse anyone for any reason.

They do however have a right to protect their reputation as a trusted place to trade online, and that means they need to weed out the people that bring down that good reputation.

A good rate to aim for is 0 negative feedback entries, but most would understand if a seller had 100 positive and one or two negatives as acceptable. Not 3 after only 20 positives.

Thanks but you missread it, on my first account was negative feedback because of that situation, but wasn't earlier. On my second account was no negative feedback ever.
Thanks anyway

Talkiet: Based purely on the fact you set a $1 reserve auction and then decided the final auction price wasn't enough for you, I reckon they were right to ban you in the first place.

I also believe once you've been banned, that's it, you are not allowed back under a new account - which is what you did.

From what you've said I believe Trademe were 100% in the right over this.

Cheers - N

if you read the first few posts, you should see that he has clean record for the second account - no negative feedback.
