Hello guys.
I had some truble with the admins of Trade Me, i was wondering if i can get some input to my case.

I had an account, which i had traded with without a problem(only positive feedbacks). Later on i was selling items for $1 reserve. A buyer won the product but is wasn't enough for me at the end of the bids. Since i had the option to give a "fixed price"(program fault) to the buyer, i took it, and then i got a negative feedback from the buyer/s. i had a little argument over the feedback with the admin of trade me. That account got deleted and banned. Acceptable, but of If I had no option I'm not going to be using it.

Probably a month after i created another account. I was happily buying - sale items, but when i went to sell again, i had to confirm my details (even though i had address confirmed). It was no problem for me, but they found out that i was the one with my previous account.

They said that they are banning the second account(only with positive feedbacks) because i had exessive (20 positive 3 negative) negative feedback from my previous account! I reckon its pretty unfair to make a decison without looking around the circumstanses, and they blame me for breaching terms and conditions.
I really want to fight for the trouth, so can you guys give me some advice on what i sould do? Or if you think i was at fault?

Based purely on the fact you set a $1 reserve auction and then decided the final auction price wasn't enough for you, I reckon they were right to ban you in the first place.

I also believe once you've been banned, that's it, you are not allowed back under a new account - which is what you did.

From what you've said I believe Trademe were 100% in the right over this.

well only getting one side of story here but on face of it they are able to do this and have whether people think its fair or not. Personally I would be miffed if I bought something fair and square and seller decided it wasn't enough.

When you say "little argument with admin "how little was it?

$1 reserve is what you listed the item, so you are obligated to sell it at $1 if that is the only bid. Agree with TradeMe on this one.




If you can't laugh at yourself then you probably shouldn't laugh at others.

+1 - if you list it with a $1 reserve then you are legally obliged to go through with that. That is the risk of listing with a $1 reserve.

Yep, once you go $1 reserve you can't complain that it is too low. I would be annoyed if I was the buyer too, and the ban was justified.

as an aside, why would it let you go $1 reserve then give option to do fixed price once auction is won?

I've done the old $1RES trick a few times on trade me.
Sometimes it has attracted the extra interest to generate a decent price, sometimes it has has ended up with someone getting it for $1.

It's as simple as that.
If you put it on for $1RES, be prepared to suffer the consequences.

Sorry, but you deserve to be banned for this.

It may have been a different story though if there hadn't been a bug in the trade me system that allowed you to offer subsequent to the reserve price being met and won.
Surely you wouldn't have said to the buyer who met reserve that you weren't prepared to sell it to them for $1 if the trade me bug hadn't happened?
You have a legal obligation to sell at $1 if it only meets that reserve price.

End of story.

So just to confirm, you first broke TradeMe's Listing Policies by backing out of a sale after it finished, you got bad feedback and then TradeMe banned you for breaking the rules you agreed to abide by, so you created a new account, against their Terms and Conditions and it's them being unfair???
