Well logically I had paid for 12 hours hadn't I? My folly was not checking the ticket on the day and ensuring that it was actually for a full 12 hours. Technically speaking though, I parked over the stated time yes.

So their machine is really up the whatsit, because according to their advertised rates you should have been entitled to stay there until 2.17AM.
Marcus is clutching at straws me thinks.

Wait,... maybe 1h30m is $7.50? + 50c is $8... but 12 hours is $8? sounds like they've got a pretty shrewd way of conning people out of $65.

How can they get away with this kind of behaviour? It's appalling.

I created this thread to raise awareness, I'll fight them even if it means I end up paying more than $40.50 going to the Disputes Tribunal and what not.

I hope no one else has to go through this again.

Does anyone have any ideas on how I should approach Fair Go and NZ Herald? Should I just post on their Facebook page?

I reckon you're on to it, their casual rate is indeed $2.50 per half hour 24 x 7 x 365

I left between 9:30 and 10pm so no I was nowhere near the 12 hour limit.

Yea I just can't believe they can do this sort of thing in NZ of all places and get away with it! Do you think this will hold up in court?

The way I see it is this:

  • Did you pay the advertised rate for 12 hours? - Yes
  • Does the ticket include the transaction fee? - Well apparently, yes
  • Did you leave within the time you had paid to park? - Yes
  • Is the problem in this situation related to the transaction fee - According to the notice, yes


They really have nothing to go on. Take all this evidence to any lawyer and they'll tell you the same. I would call them and argue it, or if you feel like being cheeky, tell them that in good faith you'll pay the $0.50 transaction fee. I'm guessing it's just a system oversight however and they will be happy to waive it if you present them with what you've posted here.

well I'll just jump in with my 2c


the 12 hour fee is $8
the CC fee is 50c


according to the ticket you had paid $7.50 plus the 50c fee (total $8) so you didn't qualify for the 12 hours, instead only qualifying for 1 1/2 hours that $7.50 gets you.

since every machine I have ever been to adds on the 50c automatically, I think it pretty unlikely that this one, for some reason, decided not to bother this time.

I think the most likely explanation is that, being in a rush, you accidentally only keyed up to $7.50 instead of $8 for your parking and pressed ok, then the machine said something like "50c transaction fee applies your credit card will be charged $8" you misunderstood and clicked ok on that thinking you had paid $8 for parking when actually you had paid $7.50

so unfortunately I think the parking company is in the right (even if seems grossly unfair) but they just explained it very badly.
they said you had not paid the 50c transaction fee. That is not correct. you did pay the 50c fee, but only paid $7.50 for the parking

Was there a clear indication that you were obliged to add a 50c transaction fee if paying by credit card?
If not, fight it.
If so, they may be acting churlishly, but they are within their rights.

What is looks like you got there at 19/8 14:17 and paid for ($2.50 * 3) + 0.50 ($8.00) for 1.5 Hours..

What I've seen on some machines and you press the time button and it increases and then goes to "Max" (or 12 Hours in your instance). I presume someone could pay for 2 Hours ($10) OR pay Max Time (12 Hours for $8).
