No. Been discussed many times. But briefly...
The Insurance Law Reform Act, 1977, Section 11.
- the insured shall not be disentitled to be indemnified by the insurer by reason only of such provisions of the contract of insurance if the insured proves on the balance of probability that the loss in respect of which the insured seeks to be indemnified was not caused or contributed to by the happening of such events or the existence of such circumstances.
Klipspringer: We had a similar thing happen to us. Guy backed into us in a shopping car park, gave us his contact details etc .. He was very friendly and apologetic at the time, stating that we don’t need to worry. He will pay for all damages etc etc ..
We contacted out insurance, who in turn contacted him. He changed his story and no longer admitted fault. He told my insurance company that we both drove into each other.
In the end insurance still covered our damage, but we ended up having to pay the $400 excess.
Lesson learnt: Next time take pictures, get a written statement from the other person involved. If need be, drive straight down to the police station with them to do this. Don't leave it. Many people out there are dishonest.

Ahh same thing happened to me. Old lady was apologetic and admitted fault immediately, so I grabbed her details from her driver's license and her car's plate number. Rang insurance and they talked to her, she changed her story and unfortunately we were on the same insurance company and the insurance people listened to her and we paid $500 excess. The other car didn't need any repair. It was my first time to be involved in an incident like this. So lesson learned. Don't let them go! Good luck chasing them.

If you can't find these people, you must tell a police officer as soon as possible and no later than 60 hours after the crash.
tardtasticx: We just finished fighting through the disputes tribunal for someone refusing to pay.
Uninsured, learner driver (no supervisor in car either), WOF and Rego-less car didn't give way at an intersection, hit the side of my car causing dents and paint stripping. We got her details from her licence, photos of her licence plate and car, as well as all damage on both vehicles, and went on our way (though I did call *555 because I wasnt sure about letting her continue driving illegally but they decided police wont attend considering no one was injured but logged it anyway). Reported at police station and asked if they would press charges but didnt hear anything back.
Insurer contacted her, she initially accepted liability and we got a 1725 quote for repairs. Vero didnt charge us excess since she was admitting fault and they had a recording of this (excess would have been around 2K for me because I was 18 at the time) She then decided she didnt want to pay and would rather get it repaired herself but Vero said we would deal with that, she just has to pay. Long story short she didnt and we ended up going to the disputes tribunal last week. It ended in our favour and she had to pay the full amount but at $30/week. She wasn't happy at all but that wasnt our fault.
Best thing to remember, do everything that will get your car sorted. Ignore the other person completely and let your insurer and the police deal with them. Thats what we done. It just gets everyone nowhere.
