I don't get why this is a big deal. It's closing a major loop hole with the internet. Why should you have less protection buying from a cash converters style online shop than if you physically walked into the same store?

End of the day, you know what your getting by buying second hand goods - the law just places more responsibility on people doing this as for profit to be responsible and accountable for what they sell.

Where does it leave Turners Auctions that sell their stuff on Trademe on a "AS IS WHERE IS" basis and accept no responsibility of it after the sale. They have their status changed to In-Trade now.

Stores like Digi Parallel and Parallel imported are covered as is anyone selling parallel goods in trade on Trade me etc

There is a specific exemption in the law for sales sold where the defects are clearly stated at the time of sale. So Turners Damaged Auctions would be off the hook, buuuut Turners Car Auctions would not.

But what about if the defect develops after it is purchased. Can they still say 'as is where is', as that would then contract them out of the CGA, but I don't think you can contract yourself out, unless for business purhcase. I guss they could always say that they will only sell to businesses, where the CGA doesn't apply. I do feel a little sorry for stores selling things second hand, as they don't know how stuff has been treated in the past

They have the "reasonable expectation" clause. I know, vague, but they can argue that you can't reasonably expect secondhand goods you pay $x for to last as long as new goods you pay $y for.

Expect the disputes tribunal to get a bit more action though.
