Not if people realise, as someone mentioned on page one of this thread - if it looks too good to be true, it probably is.

 

Maybe, just occasionally, its the fault of the people in the stampede.

 

 

While "if it's too good to be true, it usually is" does apply, if a New Zealand business makes a claim prominently in their promotional materials, people have a legal right to be able to assume that the claim can be taken at face value. Burying things in fine print or weasel words like "in value" like this business did is potentially illegal. They advertised, prominently, a $100k live cash giveaway. By law, people have a right to expect that this means there is a $100k live cash giveaway. Not vouchers.

Back to the delights of interpretation I guess. Fine print. What is fine print. How fine is fine print. What exactly is 'buried in fine print'. One persons weasel words is anothers, I dunno, de-emphasised text or just Ts and Cs.

 

Is it comparable to say Noel Leemings 'We'll match any competitors price with our price promise' which you click on to read the 11 take it or leave conditions they stipulate.

I too find this claim questionable as it's very easy to see a fake from a real note. I don't want to question people's intelligence but surely they know the difference between fake and real right?

If the story is true, I'd half expect rather than a bar that it was a nightclub. They're often dimly lit, under pressure to serve customers as quickly as possible to make them go away, and generally don't have the time to even ensure the EFTPOS accepts.

There is no interpretation here. When they have a massive "$100K live cash giveaway" - not in dispute - if there is a disclaimer that actually makes that anything other than a "live cash giveaway" of $100,000, then it must be at least as prominent as the claim that it is a $100k live cash giveaway, and definitely must be always on the same page as the claim that it is a $100k live cash giveaway.

 

You seem determined to defend this businesses behaviour, but the reality is that there is a very real probability that they have breached the Fair Trading Act by making false or misleading claims. These regulations exist to protect customers from unscrupulous businesses using lies and half truths to mislead and defraud customers, and frankly I'm all on board with them rather than the lassez-faire rubbish you seem to prefer.

From what I've read I'm confused whether they gave away any cash, gave away some cash but not $100k, or gave away $100k cash plus the vouchers.

Don't think anybody knows to be honest, I doubt they did the full 100k if they did put any money in.

MoreFM had someone that got 2x $5

 

And the original NZH articles have anonymous people claiming $15 and $20 - but that is not clear if it's 'real' or the fakes as you say

 

A West Auckland nurse, who asked not to be named, said she picked up $15 and her husband got $20 in the mad scramble after the gun was fired.

It also has his initial claims which have since got a bit muddy.

 

"It was $100,000 in real money, and the fake money discounts on top - I think that was 40,000 notes [coupons] that were printed," he said.

 

 

 

If your maths is like mine.. I'm fairly sure 40,000 fake $5 is a further 200K... that's a fairly big claim to make, and obviously not well audited.

I read an article that said that is was 100k in cash, and about 40k in vouchers. 100k in notes may not actually look like that much when thrown into the air into a large live crowd. But whatever the case, I can't understand why they thought this sort of promotion was ever a good idea.  But the free publicity they have got would have cost far more than 100k. But saw the Prime Minister wasn't happy about it and has asked them to apologise, and also couldn't believe that someone thought it was a good idea.
