There is no NZ entity from which to seek enforcement for a CGA claim.

NZ tax law does apply as every import to NZ is subject to gst. Amazon collect that tax on your behalf as they are obligated to.

 

So what would happen if Amazon said "sorry, we're not paying GST, NZ"?  There is no NZ entity from which to seek redress, surely?

 

 

Then you would pay.

I am more interested in if they have opened other amazon stores back up to NZ, since july is when they have started to have to comply with a whole lot of destination VAT/GST rules in europe that the AU and NZ ones were modeled on. I miss UK and JP amazon stores for exclusives to those regions, whereas the AU one just has mostly the same tat as local at a slightly better price.

The Australian Competition and Consumer Commission has a memorandum of understanding with the New Zealand Commerce Commission and Ministry of Consumer Affairs as detailed on this page - the Commerce Commission can exercise ACCC's authority (and vice versa) to protect NZ consumers under the ACL, same as how ASIC and MBIE can exercise each other's authority to hold directors of companies in the other jurisdiction to account.

I don't think they can take any action though - that would require enabling legislation which I don't think exists. It's an MOU which says it's not binding in any way. To make it binding in NZ would require enabling legislation.

 

I read this as it would have to be the ACCC taking action in Australia on an Australian company.

My US login worked fine. 

 

 

Mine also works on all of the amazons, but with password managers it may have a wrong one saved on the other domain names.
