Haha - I was half way through writing something similar, but thought better of it. My reading is that the cop saw the iPhone5 and thought, hey, here's someone with more money than sense ... (no offence intended towards the OP)
(Edit = typo fix)

Next thing I know, a cop comes up to me and asks for my licence, so I show it to him, he writes down a few things, asks if its my car, so and so. Then says "Expect your ticket in the mail" and I replied "excuse me? What for?" (Keep in mind, he had not said anything prior to this, other than "Can I see your licence" and "is this your car". He said "don't text and drive" to which I replied "Well actually Im not, and the car is stopped" and he just walked off. Another thing to note here, he hadnt pulled me over, he actually just walked up to me because traffic was completely stopped.

I think your last sentence here could be significant. If you get a ticket for using a mobile while in the flow of traffic, then is an officer allowed to do all that ^ while you're in the flow of traffic? I'd suggest he should have pulled you over to the side of the road out of the flow.
And is he sure you were using a phone? It could have just been a camera. Plenty of cameras look like phones if you don't look at them too closely. You have the photo right?
tardtasticx: Lol the amount of people who have said "Omg you always say you're so broke blah blah" (I'm a full time student) is insane, they know this phone costs a lot but I got it on contract, taking $250 off the price to start with, and I got 12 month deferred payment, I havn't actually paid a single cent of this phone off at all yet.
tardtasticx:And exactly, traffic cant be in a flow at all if an officer believes it is safe enough to walk over to my car and take details.
mattwnz: Part of the problem is that laws don't keep up with technology. A phone can do so much more than simply make calls and txt. It could be used as a GPS device or camera, and if you were handling either of those dedicated devices in your car, they wouldn't probably care. But because it was mobile phone shaped, then the law kicks in, and it is probably very difficult to prove that you weren't txting or making a call when you pick up a phone in a car.
Here is a crazy notion, lets give peace a chance.
KiwiNZ: You could take the attitude that the Policeman was doing his job of trying to keep you and other motorists safe on the roads.

If they really wanted to do something, they would increase the fines and take a tougher line on actuall calling and texting, who are actually 'moving'. There are still a huge number people I still see driving with a phone next to their face (many are realestate agents). Many I suspect see the fine as a small price to pay for the loss of business of not answering the call.
Here is a crazy notion, lets give peace a chance.
