Just lovely. Hey, did you hear about that Kim Dotcom guy? Yeah, shame what happened to him. Be terrible if it happened to you. Tell you what: you pay us $100M a year and we'll make sure it doesn't happen to you too.'


I don't think that will happen, DB, Google, Microsoft or IBM are not headed by crim's ;)


I'd put money on the fact that they are hosting copyrighted material on their servers. That would make them crim's wouldn't it ?

Precisely. They're going after him first because he's so punchable. But he didn't do anything that isn't being done by other cloud service providers too. And once they've got him done, it's open season.

And soo it is the same as the whole 'Global Mode' debate.......
If a company, corporation, or country, doesn't say that it may have done something, then it retains its credibility without tarnish. But if a competitor stands on its toes, there is litle remorse in pointing out the illegal actions and working hard to make sure the world helps make the muck stick.

Gentlemen have always read other gentlemens mail
Servers will all contain illicit and illegal data
And all people will take advantage of some loophole at some stage thru their lives.

But real gentlemen won't discuss what they shouldn't have read
Credible Data bankers and server farmers will only look at traffic stats, not content
And People will always gather for a free lunch without reading the fine print

In this way as individuals, governments, or institutions, we all retain the right of plausible deniability.
Would the TPPA have removed that?

Good question, the answer is it depends on who can make a few $ from it.
The ideal situation is for a company (who claims to be a victim of copyright fraud) is to be able to garner some sort of deal where they can simply grab, legally, historic metadata from an ISP, post out some fines for retrospective breaches and send a bill to hundreds of thousands of users.     http://www.gizmodo.com.au/2015/02/how-australian-internet-providers-will-start-busting-users-for-piracy/comment-page-2/

he trick would be to string it out so that users don't get hit all at once, start off with small fines.
Would the Tpp make it easier to dish out fines for retrospective behaviours ?

No it would not as they actively police it and remove it if discovered.

I also wonder if the whole flag debate is just another issue dreamt up by team JK to distract people from the TPPA.

But Megaupload did too. You will note that the reason the US government says they don't qualify for safe harbour status is that they have access to internal emails where employees discuss knowing there is copyright material stored. Emails they didn't (legally) have access to until after they had already shut it down. Publicly available information on the case shows that Time Warner alone was able to make 5,000 takedown requests a day. And you can take their word for it that they certainly weren't abusing the system.

Again, what it comes down to is that he's an easy target because he's so unlikeable. But whether you think he deserves it or not, I think it's hopelessly naive to believe they won't immediately use a conviction to shakedown every tree they can get their fingers around for as much as they can get off of it.

Probably not.

The flag change has a defined timetable and process now.

If you need a distraction, you really need something that can be introduced quickly e.g. snapper quotas to cover the GSCB bill.

Personally, I do support a flag change. But, that's another topic.
