^ easy, you want a refund.

 

It is your right under the CGA.  Had the same with a TV through Samsung they couldnt repair (4 ish years old).  Offered me a new model, but I didnt want it as had already replaced it.  I said to them in an email that as per rights under the consumers guarantee act I want a refund and they did no questions asked.

This behaviour is not allowed under the CGA, while some may aceept it you do not have to.

You should now try for a full refund of the original purchase price which would likely be a credit through the retailer. Then you can purchase whatever you want at the same retailer. I am not sure if they must refund / Credit after 3 plus years but you can give it a go. Otherwise a replacement machine with a full new warranty is still a good outcome. Bosch are normally a very good product. 

 

 

I wouldn't say I've had a great experience with Bosch but I think your particular issue had some complications and as a result, I'd expect them to push hard to replace your machine rather than refund it, and for most people Bosch is a good brand.

Thanks so much for your suggestions.  Regarding a refund, can I ask for full or is it abated by some method as I got some use out of it.

If you ask for a credit through the retailer of the original purchase price you are more likely to get a result than asking for Bosch to pay directly to you. Then bosch can apply a credit to the retailer's account for the cost price of the unit & the Retailer still mantains their MU by suppling you another washing machine of your choice with you paying the difference if any between the credit & price of replacement. Plus you get a full new warranty on the replcement.

When a faulty product is replaced, any manufacturer’s warranty on the product usually runs only from the original purchase date.

So, if a 6-month-old washing machine is replaced because it is faulty, and there was originally a 12-month manufacturer’s warranty on it, then this warranty will have 6 months to run on the new machine.

However, the Consumer Guarantees Act applies to the replacement, so you will still have all the rights you’re entitled to when buying a new machine.

Well I checked out the model the offered, there a couple of fundamental differences in that the one now offered is NOT an anti-flood aquasequre model and doesnt offer a 90 degree wash , and you cannot select the temperature on any programs.  The guy at the appliance store said it was their 'entry level' machine.  I have gone back to them asking for a like model, or a refund, or a store credit.  I hate Bosch, although the dishwasher is doing well, after nearly 6 years no issue, but I still hate Bosch.

Always go for a refund not a store credit. Last time I got a store credit, they wouldn't allow me to use it on a price matched price, they said I had to pay the retail. Cash gives you far more options and control.

From legislation online.  I consider goods of the same to type to mean they have to give me an aqua stop model since that is what I have now.  If they dont want to do that, then I have said refund is fine.

 

23 Consumers’ options of refund or replacement

 

 

 

(1)

 

 

Where the consumer exercises the right to reject goods, the consumer may choose to have either—

 

 

(a)a refund of any money paid or other consideration provided by the consumer in respect of the rejected goods; or

 

 

 

(b)goods of the same type and of similar value to replace the rejected goods, where such goods are reasonably available to the supplier as part of the stock of the supplier,—

Well Bosch came back and offered another model that met the same specs that I have now........comparing the retail price of it and vs what I would get as a refund, its probably and ok deal as long as the thing actually works.  If it were near XMAS, I would have demanded a refund.

Yes I accepted it - am just really anti front loaders now, and very anti Bosch and wonder if their if first offer was deliberate, but can never prove etc
