I just noticed some spam (It has been a long time sine I got spam from a NZ companies since the new laws came in ) from www.bellow.co.nz trying to get me to authorise a "free listing " on their directory.

The funny thing is they actually have a link to the dia's website and say..

This email complies with the New Zealand spam laws. (See http://www.dia.govt.nz/diawebsite.nsf/wpg_URL/Services-Anti-Spam-Business-Info#four - Deemed Consent). You have received this emailed because your email address is associated with the above business. If you do not wish to be emailed or have your website listed on www.bellow.co.nz you can contact us or use the unsubscribe link below and we will remove your email address and business removed from our directory.

They forgot about the important part..

"There also must be a strong link between the message and the recipient’s business."

Anyone else get this and want to comment..

Report it. There's no bloody "strong" ties between your business (since you never actually have done any, you know, "business" with them before) and a new company.

Spammers should die in fire.

And their website couldn't be more useless. Looks like they just scraped yellow.co.nz and WHOIS listings, and then poorly mapped business classification to their own categories. For example, did you realise that the Corban Estate Arts Centre is a computer system design company, that can build you a website? Me neither. And Swanson Transport too. They aren't a logistics company, they're apparently a front for a web design company too.

Ridiculous.

I got emailed by them about a month ago, but it was delivered into my spam folder automatically, so their server is probably in RBL databases.

Reminds me of some fax spam I received from a business - tracked down the business and phoned up the guy. What did I get? a bunch of spluttering and "oh, ummm, oh". Honestly, such individuals need to die in a fire because once again it is a group of people who think that they can make it 'rich' by doing nothing other than irritating other people in the process.

Not sure how effective submitting a spam complaint is these days, as I have submitted a few and you never hear anything. Interesting some of the companies that have been prosecuted though, some quite big ones. Wish there was a quick and easy way to submit a spam complaint , like there is with gmail or mailchimp.

I submitted a complaint about Brendan Battles the spammer for SMS SPAM and 2 DIA staff flew up from Wellington to interview me and others that had laid complaints and he was prosecuted,

I suggest anyone that gets email SPAM from this business lay a complaint via the DIA website

After the NZ Antispam laws came into affect the amount of NZ sourced spam (That I saw) reduced a lot ( from say one spam per week to about 1 spam per 6 months)

I still get spam tho. I have a NZ Fax number about 6 months ago and I get about 1 spam fax (from faxads.biz ) every month. Yes maybe the number was "reused" from some other company in the past.

Go to : http://complaints.antispam.govt.nz/EmailComplaint.aspx and start the complaint there.

Done. Wasn't as hard as I had anticipated.

While looking through my email, seems they've emailed me twice, but the second one was trashed automatically.

I am the owner of Bellow.co.nz and would like to obviously reply to your feedback regarding this site.
If you read the New Zealand Spam Laws at http://www.dia.govt.nz/diawebsite.nsf/wpg_URL/Services-Anti-Spam-Business-Info#four

This states

Deemed consent
Deemed consent is when someone conspicuously publishes their work-related electronic address (e.g. on a website, brochure or magazine).

However, if a publication includes a statement that the person does not want to receive unsolicited commercial electronic messages at that address, consent cannot be deemed.

There also must be a strong link between the message and the recipient’s business."

So if you publish your email address you are inviting emails (unless you request not to be contacted) and their is a strong link between the message I have sent and the recipient's business - I have advised you the recipient that your business is listed on the website Bellow.

And I have followed all the requirements as far as identifying myself and how you can unsubscribe. if you do want to be listed simply unsubscribe.

I will continue to work on the functionality of the site and trying to ensure try business are listed in the correct categories.

Hi Bellow

That is not deemed consent if a email address is published on a website, Like saying if an address is in the phone book that gives a business right to post them advertising via snail mail or come knock on the front door and sell you something

Why should they unsubscribe if they never subscribed in the first place?
