So I see a car I want. Its gotta be worth about 6g. The auction listing was pretty vague, but he said he was open to swaps and offers. It was a $1 start / no-reserve auction.

I bid $3g (autobid).

Auction closes at.... $1.

Before I even said anything to him, he emails me being a complete 'tard (that description is missing a naughty F word on the front).

His first email to me was "Have you even GOT 8 grand?????????"

This, despite the fact that nowhere on the auction (or on the Q&A) did it mention $8,000 as being a price he was aiming for. In fact - no price mentioned at all, other than the $1 reserve on a car that isnt even going properly (which I was happy to buy, so made a bid).

GAH.

And of course if I give him bad feedback, he will retaliate with the same, so I wont, and the TM reputation system looks shaky as ever.

Still GAH.

I was lying about the rant being over.

/rant could still go some more....

Of course I don't expect to get the car for $1, but I dont expect to have to deal with such idiocy either.

LMAO, according to trademe rules he has to give you that car for$1, talk about a good deal :P

I never understood why people do $1 auctions if they cannot sell it for less than a certain price.  It is not garunteed to you, so why do it!?  I guess the only thing you could possibly do is point out to trademe that the seller is failing to provide the product for the aution price (paste in their TOS that applys) and suggest they ban the member.

 

The feedback system is a crock, but i guess there is no other way for trademe to watch it without being increadibly labour intensive!!

The rules are that auctions and bids are a contract to sell and buy. Did he offer a "Start = Reserve"? If so then he must sell it for $1 and you should contact Trade Me if he refuses. If it was just running a "Start = $1" then too bad for the bidders who didn't reach the price he had in mind.

how much is the lawyer's fee if you go to court to get your 6g car? that's what normally puts people off challenging things in court. *sigh

also, i completely agree that this world is full of idiots. and most of them seem to lurk around the tarmac and trademe!

Know the feeling Tony.... 

A friend had fun issue with a Trademe user along similar lines... seller was advertising a projector for (dont know exact numbers so Ill make them up) $400 Buy Now.
So my mate hit Buy Now and the seller came back and said "oops, that was meant to be the start, not the buy now, Buy Now is $1200 ".
 My mate said tough, give it to me for $400 or Im taking you to court. The seller gave it to him Smile

What car are you after anyway ?

But if it was a $1 reserve auction then that is a risk he took and you should, as a matter of principle, cruise round there and pick it up? (once he sees you he won't be arguing)

The vehicle is out of his home district, and neither him nor the car are in Hawkes Bay.

Otherwise I'd go pick up my car.

I don't need the hassle, so I thought I would just walk away, and make you guys put up with my raving.

What car are you after anyway ?

It was a four-wheel drive turbo coupe. Looking to get more serious in next years racing.

He could also take them to the disputes tribunal, however the seller may have made a genuine mistake. It sounds like it was a youth who was selling it, who probably doesn't even understand how auctions work, and that they are a legal agreement. I don't have that much faith in some of our youths of today and their attitudes, especially if they sent you an e,ail with that sort of language. I have dealt with a bad trader in, and it just ends up damaging your feedback, when they also post bad feedback.

It was $1 Start with $1 Reserve (ie yellow flag with $1 next to it).

It's not worth the hassle to me to do anything legal-wise.

Man, redface him with pride, if he retaliates, forward his email, they'll probably disable or at least remove the red.  Put a comment under the one he gives you.  If your feedback is otherwise good, people will see it.

I must say my frustrations with Trademe are growing by the week. A while ago I purchased a CD titled "Goodby Mr Pink Floyd". Well, me being a Pink Floyd nut paid $25 for it. What I received was a copied CD, and two other copied CDs.

Totally disgusted, I emailled the seller and she packed an attitude with me. I took the matter to Trademe and they sent me one of their usual automated responses with a reply-to of noreply@trademe.co.nz - figures.

Its getting to the point where I'm going to open a paypal account and start using eBay.

I've had several unpleasant experiences with Trademe. The most they do though is refund the sale fee (if you're lucky).

However, thankfully, the sale is a legally binding contract - provided the person selling is at least 18. Tony is probably right, screwing a kid out of thousands of dollars doesn't bode well in karma terms but his attitude deserves a little scare.
