I had a pair of Salomon tramping boots break.  They are less than 1 year old and the rivet on a lace loop broke.

 

The retailer has accepted the claim.  No issue there.

 

But .. they have elected to send the boots for assessment and possible repair rather than replace them.  This could take up to 6 weeks.

 

The trouble is, I have several trips planned between now and then and I need my boots.  I've explained this politely to the retailer, but they were unmoved

 

I'm basically going to have to buy another pair of boots.  Do I have any options here?

IANAL.

 

By law they have to act within a reasonable time frame. Personally I would not consider 6 weeks a reasonable time frame, others however might. 

 

Assuming your first planned is a couple of weeks away, I'd go back to them. Tell them you are giving them until the date of your first planned trip, you expect them to be repaired or replaced by then and if they don't do that in time you expect a full refund.

I dunno if I'd want to go tramping in new boots, I'd like to wear them in first .

These are fine - they are synthetic.  I wouldn't do that in leather.

 

Best fitting, most comfy boots I have ever owned.  I've never even had a hot-spot wearing them.

Bung: Why 6 weeks? I wanted to buy a pair of shoes that had a faulty eyelet but were the last available in my size. The retailer managed to get them repaired in 1 day.

 

They go overseas for assessment.  6 weeks was a ballpark estimate.  In reality three weeks is going to be problem for me.

 

I don't think repair will be possible as they'll have to separate the inner and outer upper to replace the component that has broken.  Hopefully they reach that conclusion quickly.

I think it's reasonable if it's not a NZ made boot, retailer has the right to redemy rather than refund

I'm currently trying to talk them into sending photos of the problem first.  That way if there is no way to repair we don't waste time shipping the boots to wherever.

 

Also found an overseas seller of the same boot at a sharp price, so may buy a second pair as well.

Assuming 6 weeks is unreasonable, looks like (2)(b) gives you the option to get a fix somewhere else and send them the bill, or reject the goods (get a refund).

Are they usable with the broken rivet? If they aren't it is a failure of substantial character (ie makes them unable to be used) and therefore you can chose the remedy.

 

This is quite poorly understood, a failure of substantial character isn't the size of the component that has failed, it's the impact it has on your use of the product.

I had them back in two weeks time, absolutely like new.

 

Now you can have it done locally... but this was sending them across the ditch for a 'service'.

I have just ordered something from oz, it got to the airport in 1 day, then was scanned each day for a week to get to the front of the queue for the flight over to here, then sat for 1.5 days before clearing custom, then a day to get to me - that over a week in just shipping at the moment - one way, 6 weeks oversea is not bad I feel in this covid-19 shipping times.

Agreed. I did Le Haute Route (a mountaineering route about 85 miles long from Chamonix to Saas Fee) when I was about 17 and did it in what were then the new fangled plastic mountaineering boots.

 

They have double boots, with a softer inner boot. What was not known then as the concept was so new was that they should be sized a bit less generously than normal boots. 

 

As a result, I actually have scars on my feet from the blisters which developed on day 1 and which were then rubbed raw climbing and descending daily for the next 12 days or so..!

 

Thus every time I put socks on now, I see visual reminders of that trip.

I did the Milford in these boots when they were near new.  No issues at all.  Not even a single hot spot.  I generally have a bit of trouble with my feet but these boots are fantastic. Nicest tramping boots I've ever owned.

 

Just ordered a second pair out of the US via YouShop.

They are.  I'm just skipping those lace loops on that boot.  Seems to be OK.
