If a store is offering a deal of "buy two items, get a third free" (usual equal price or lower applies) but has a clause of "free item must be returned if one of the paid items is returned", can they do this ? Anyone been in this situation ?

 

 

 

ie:  Buy 2x 32GB USB sticks, get a free 16GB one.  Decide I don't want one of the 32GB and return it but get asked for the 16GB back.

 

 

 

Pretty sure the freebie would have to be returned, but just other views on it.

Hard to understand why you are querying this - their policy seems clear and fair to me. Otherwise it’s open to abuse by their customers. Do you think you should be able to return one of the 32GB and still keep the free 16GB?

Its not anything Im looking at doing, just helping someone out who wants to do a "buy two, get one free" offer and making sure their wording/terminology is correct :)

I think if the customer was returning one stick just because it wasn't wanted. Then since the store has no legal obligation (under the consumer guarantees act) to just take a return because the customer decides they no longer want a working product. The policy would work as written, they wouldn't have to take the return unless the free stick was returned as well.

 

 

However I think things might get a bit more murky if one of the sticks was faulty, in that case if you were returning it due to a fault I'm not sure enforcing the return of free stick would be enforceable or not? Of course I'm not a lawyer so I could be way off here.

Generally in that case you would offer a replacement, not a refund.

Original deal is
buy 2 get one free . Or in reality, 3 for the price of 2 .

 

In no way should it be expected to magically turn that into buy 1 get one free .
:-)

 

the deal is 3 for the price of 2 .
If one stick is faulty , its still covered by warranty as it was part of the original deal.

 

That 3rd stick was never 'free' .
They simply gave a better deal for 3 . It was worded/marketed as free as that gets our attention.
