I posted the same Q on reddit but didn't receive a fulsome answer so I thought I'd try here.

 

  • Company has a leave policy of no more that 2 weeks consecutive leave.
  • I work 5 days a week(40hrs) & 2 days unpaid(weekend).

     

  1. The question is can an employer include unpaid days off as part of the 2 week count?
  2. Link to relevant employment law indicating Yes or No(I have googled but keep drawing a blank on consecutive days.)

  1. It doesn't matter if you work a regular 5 on 2 off pattern. You are either taking 2 working weeks or two calendar weeks. In reality most people take 2 weeks leave but have 16 days off. Weekends aren't leave, they are non-working days. If you have a rotating shift pattern it's more difficult.

Just to add your leave date would normally be from the first day you normally work - i.e. you are on leave from Monday if you work Monday-Friday. You are not on leave the preceding Saturday and Sunday, that's a normal weekend.

Wow.. I know a couple of companies that requested you have a conversation if you needed >2 weeks off, but it wasn't a hard contract requirement.
