Hi people

i wonder if anyone can help with this.
We have a shared driveway and live in a rural area.
The problem is this our neighbor runs trucks and tractors up and down this drive past our house we all get along quite well and this has never been a problem to us but now the drive way is becoming unusable and needs repair.
I understand that we are all responsible for the upkeep of this drive but i am wondering if our neighbor is actually allowed to run large trucks tractors and stock up and down this drive as these do cause a lot of damage and in the past we have had cars damaged by the stock.
Any input greatly appreciated.

What type of title if the driveway?, is access granted via an easement over the driveway, or is it owned in common?

If it is a rural driveway there may be an expectation that Trucks and tractors are expected, but you are probably going to either negotiate with you neighbour(s) over what share is to be apportioned to each party.- but you might need a lawyer if you cannot get an agreement on price that you accept.

basically its between the owners there may be a certificate of title or some document of who"s responsible for it at your local council, but all the council cares about is that it has to be a certain width ,

As has been suggested - talk to you neighbour.

If it's your typical rural driveway it will just be gravel and the neighbour may have the machinery to tidy it up (or have a mate with the gear).

Just out of curiosity, how did you deal with the cars that were damaged by stock ? Did you speak to the neighbour in this regard ?

How you handled the damaged cars may have a bearing on the negotiations.

With all this wet, it doesn't take long for a gravel driveway to be ripped up by trucks and tractors, especially if there is a slope - all the gravel washes down to the lowest point.

i know with our sheared use drive ways we split the cost 50/50, if you offer your nabour a box of beer he will more than lightly fix the drive way as he will have a grader blade.
