Hello there,

I have been a fan of the one day bargain site until recently. I have purchased a number of goods and actually found that there has been no benefit to  buying them via the site. I often end up paying more for the shipping fee. Someone once told me that 1-day actually keep the local courier depot in business.

My issue is their “Why pay?” Marketing. Recently I bought a vacuum purely based on this marketing it said why pay $199? For a vacuum for $79. What this said to me was that it was valued at $199 which it wasn’t. It was actually cheaper at the Warehouse! I would never buy a $79 vacuum and am embarrassed with the purchase.

I noticed the other day that they had a duck shooting kit that said “Why pay $1200?” buy now for $39. Prices aren’t exact. But then they explained that the Why Pay is really a load of crap.

I feel that their advertising is misleading as it will and defiantly has caught others out.

Would 10 grand be enough to successfully sue them on this?

It appears to me that some online retailers can act in this way and that they are bulletproof, it really pisses me off with this kind of behaviour.

I agree that the "why pay" prices listed are more often than not entirely crap, and that products can typically be sourced elsewhere for a lot less, however to be fair to comply with the act they only have to show that the product was actually available somewhere for the "why pay" price, I doubt they are obligated to find the best price and then compare their price with that. So in that regard they probably haven't technically breached the FTA.

I use to like 1-day and they use to have some good deals, but lately they don't seem to offer much other than rubbish or products I can get elsewhere at the same or better price.

As always... "Buyer beware"!




Lazy is such an ugly word, I prefer to call it selective participation

Seriously, dude? The duck shooting thing was just a bit of fun, I don't think anyone (except the most gullible) could've been misled by that.

As for your "embarrassing" vacuum cleaner purchase. I can imagine your dismay, what if someone comes to your house and sees your <$79 vacuum cleaner?! "The pain of it all! If only I'd bought a $200 vacuum cleaner! Argh, woe is me!"

In actuality, you did buy a $79 vacuum cleaner. Maybe you got sucked in (excuse the pun) by their "Why pay?" claims, but that's noone's fault but your own, with one caveat. I'm assuming that you can buy that vacuum cleaner (or one very similar) elsewhere for $199. The fact that a single retailer may have it cheaper is irrelevant.

Now, considering that you were so caught up in the moment that you couldn't google the model and determine if it was really worth $200 (the first thing I do) then I doubt you have any idea what places (other than The Warehouse) are charging, and if you do then I would suggest next time the time to do that research is before your purchase. If you decide it's not worth it to get it from the site, then you don't have to buy it.

Of course, what's worse? The shame of buying a substandard vacuum cleaner or knowing you missed out on the bargain of the century? The dilemma!

I say go for it, use the 10k you have .... nothing like throwing good money after bad.

Marketing is just that marketing... It's like the Ginsu Steak knives, they can strip electricial wire and cut nails in half !! , I don't know why I havn't brought everybody I know a set.

What are thy really doing wrong??

They are not offering the vacuum for $199, merely suggesting that you wouldn't pay that much for it. Which you confirm.

I think you'll find there's a difference between saying
'Why Pay $199' and indicating the unit has previously sold for that amount elsewhere.. as in; 'Was $199 now $79'.

It's marketing in a way that tempts you to see the numbers and not the text......
How many people actually go into Briscoes and pay full price when they can wait a week and get the same item for 20-50% off? Would you spend ten grand on taking them to court??

Send me five, I'll buy you a beer, and we'll both feel better.........
(I might even throw in a Dyson)

I don't think he is so no need for name calling, just pointing out marketing is marketing nothing unfair with that, they are promoting their products , up to the consumer on if they buy or not...

So you brought something unseen off the web that wasn't as good as quality as you wanted.... hmmm, really not something you can sue for I would have thought.

When you purchase from them you are sent a survey to fill in.  I'm commented a few times back to them about the price claims.

The other thing is when they make those claims about a product you can buy locally anywhere in NZ, but they do not include the postage in the claim.  For example a can of coke is $1.50 here, and they sell it for 0.50c.  It's no use saying it's $1 cheaper when postage costs $3.00 etc.  It's online so you have to pay postage, so I think that should be included in the total cost.

Anyway, whilst I know what you mean, they aren't actually doing anything wrong so it's simply buyer beware.

I smell it too!

I don't think you have a leg to stand on though, they could just be going off the manufacturers RRP. Doesn't mean to say everyone has to sell it at the RRP, it just gives an idea.

Sometimes they do have good deals on them, like the bulk packs of king size chocolate. They were amazing!

Are you going to sue every retailer, supermarket and online store in the country?

.. because pretty every sale price listed everywhere will list an RRP that is slightly inflated that the product never actually gets sold at.

Never heard of Briscoes?  They have seem to have the best every amazing sales prices every week.

Honestly it sounds like you have buyers remorse from not researching the product better before you purchased it at that price.

I totally get it, but what makes you think it's not a quality product?  Just because The Warehouse sells it for $79?  Would it make you feel better if they charged $199 for it?  It's still the same product!  Your argument doesn't make any sense.

Is it a good vacuum cleaner or not?  If so, great!  If not, paying $199 for it wouldn't have made it any better!  Is there something specific about it that doesn't work?  If so, you probably have a claim under the CGA.  If not, what's your real problem?  It seems like it's just that you didn't get as good a deal as you thought you did.  Live and learn.
