Does anybody here know how the copyright 'infringers' are tracked from the copyright holder's end? Just information from torrent trackers I suppose?

There are so many holes (or should we say flaws) in this new legislation it seems shocking to me that it has been passed into law.

Copyright owners often buy infringement detection services from third party specialists who use a variety of detection methods. Detection is based on IP (Internet Protocol) addresses. One method is for copyright owners to buy a list of offending IP addresses and send notices to all of them using automated processes. In this case, it doesn?t matter whether the person is a one-off downloader or a high-volume downloader.
On the other hand, some copyright owners overseas are known to specifically target IP addresses that occur frequently in detection lists or are big file sharers. So they do have the ability to target action against specific IP addresses if they choose to.
Illegally downloading a movie or TV show one-off is less risky compared to downloading lots of files based on probability of detection. But even downloading a single infringing file can lead to your getting a notice.

I'm still interested in how the third party specialists would get hold of that information.

I would imagine that the copyright 'infringes' set themselves up as normal torrent users. They too download some illegal material, seed it, sit back and wait for some IP's that connect. They then send notices to those ISP's from where the offending IP's originate.

Simple really, but full of holes. IE, just because an IP address was connecting, and downloading a small portion of the file, and even if the file was never successfully download, and watched. The user is still in breach.

If they can get an invite they can start tracking, it's just harder for them.

What a debacle! It's okay though, because none of us download copyrighted material anyway...

Bit torrent uses trackers to provide a list of peers and seeds, you can easily write software that connects to the tracker and records the ip addresses of seeds and peers.

Popular torrents that infringe on copyright on any public torrent site (like say the PirateBay) are likely already being monitored and your ISP just throws out the infringement notices currently.

Private torrent sites have private trackers so to connect to the tracker the people doing the monitoring would have to have an account/be a member which is unlikely but is possible.

Consider the other ways people get files that infringe on copyright:
- Search on google, download using http/ftp from website/forum/blog
- Search on usenet/newsnet type site, download using nntp
- Search on other filesharing network (kazaa, emule/edonkey, limewire etc) and download from other user
- Search on IRC, download directly irc/dde from another user

I don't really see how the law will stop those ^ because to monitor the download the user serving the file you're downloading would have to be the infringement company/agent

If they are offering the file then tracking downloads of it.. well isn?t that entrapment? If they are the ones offering the file is that even copyright infringement since they are the ones giving it away?

Bottom line is the law is effectively useless and a waste of everyone?s time and money.

Anyone remotely tech savvy will download via a cheap overseas vpn/seedbox/proxy adding a layer of obfuscation to tracking the ip address.

The only way for the industry to beat coypright infringement of tv/movies is to compete with it by offering a better product/service like Steam (PC Gaming) and iTunes/Spotify/etc (Audio) have done.

Why would the cache go? They are not covered by this law, and they only seem to fill it off slingshot users based on how much I have ended up spending on uploads to the damn thing.

Only if they get a notice to remove, would they have to remove from the cache. And I expect by the time that notice arrives and is processed that most people who want it will have already got it.
