We have a fibre install that is approaching month 12 and although we've crossed most hurdles, a final one remains.

The office that is having fibre installed is located in a business park. The BUDI is located in a different building in the complex occupied by another tenant. The complex is owned and managed by a single landlord.

The final permission to be gained is to use the BUDI.

Spark have advised that consent to use the BUDI must be gained from the landlord/body corporate.

Chorus have rejected the landlord/body corporate's authorisation and stated that it must come from the tenant.

The tenant will not sign as they believe it is not their responsibility, and Spark have told the tenant in the location of the BUDI that the landlord/body corporate’s authorisation is required, not theirs.

Who is correct?

I would be expecting the body corporate to intervene and get stuff done.

There could be some very good reasons for this approach, but the instances where this would occur are fairly rare.

Can you please DM me the following details;

Name of your company (the name under which you applied for fibre service from Spark)

Your physical address (where the fibre is to be installed)

The order reference number given to you by Spark

Your name (or the contact name for the person in your organisation who is dealing with Spark)

Contact phone/mobile number for above.

I will get one of our property specialists to investigate and liaise with you and the team at Spark to ensure we are taking the correct approach in this instance.

Thanks

The situation is at an impass with all parties pointing to the other. Unfortunately in these situations it's just easier to intervene myself and try to work things through.
