We have a fibre install that is approaching month 12 and although we've crossed most hurdles, a final one remains.
The office that is having fibre installed is located in a business park. The BUDI is located in a different building in the complex occupied by another tenant. The complex is owned and managed by a single landlord.
The final permission to be gained is to use the BUDI.
Spark have advised that consent to use the BUDI must be gained from the landlord/body corporate.
Chorus have rejected the landlord/body corporate's authorisation and stated that it must come from the tenant.
The tenant will not sign as they believe it is not their responsibility, and Spark have told the tenant in the location of the BUDI that the landlord/body corporate’s authorisation is required, not theirs.
Who is correct?
