My last neighbour was like that. Front house/back house setup, and he was renting the place at the front but acted like (read: thought) he was the owner. Fortunately, he got evicted for doing exactly that (he threatened to trespass me from "his" property).

I'm hoping that by the time the fence needs replacing, I won't be living here anymore.

Or, if it does need to be replaced, we can gently detach it, and then reattach to the new fence, without having to pay $$$ to Chorus.

Technically it's my fibre on the neighbour's fence. So the biggest problem will be if they demolish and replace the fence without telling me.

Chorus have just laid fibre down my street. I have road frontage so no issue for me but there are five neighbours behind us on a shared common driveway. There's 5 cables poking out of the ground at the minute very close to where my boundary fence starts. This fence must be 25yrs old and will probably need to be replaced in the next 3-5yrs. When the chorus tech comes out to scope my install I'll be very clear that my neighbour's is not to be installed on my fence. 

I have no desire to delay my neighbours from getting access to fibre but it won't be going along my fence.

I hate fence installs, Visionstream wanted to do that for me, I said no, find the copper duct (ended up having to dig myself for the useless visionstream contractors) and I got the fibre cable along side the copper in the same pipe, my install is neat, my neighbours one is along the fence, when it comes to replacing that fence in several years time I am going to say, you agreed to it going along the fence, you can pay for it to be moved when the fence needs replacing.

My neighbour told me the pipe was "blocked" I said they told me the same thing, and pushed them to run it though the pipe.

Your fence? If it's a boundary fence they have just as much say as you do.

Good luck, you'll need to hover over the installers to ensure that happens. Scopes are very hypothetical. Even if you are lucky enough to get a scope the installer will deviate it if they identify a shortcut, and your wishes will be a long cut. My first place, the Scoper failed to show up to appointments and the installer seemed to made it up as they went, resulting in a cock-up. My second place they scoped conduit on a concrete retaining wall on one side of the driveway (which I was OK with) but the final install was attached to the precariously leaning wooden fence on the other side of drive way. 

OP - was there a scope at all?

I'd speculate somebody was winging the OP's job too but the gamble didn't work out when the neighbour saw them.

 Worst one was a block of flats my son was renting in. nextdoor (joined together type flats) was a deranged guy whos daddy had bought the flayt.

He put padlocked chains across the other carports and all sorts. he'd go out and rant and threaten.

One large pacific region neighbour got the bolt cutters and cut his chain, and threatened to smack him, so he called the cops.

he was always calling the cops, who didn't want anything to do with him.

The landlord of the other flats was good, but was always having to turn up to sort stuff out with this d***.

My son walked past one day, his flat was behind this guys, and door open and he was in there molesting his vacuum cleaner.

so son started to call him a certain name and he tried his hardest to get my son in trouble, ringing cops and reporting non-existant violence and all sorts.

Some people are just total a******s.

Yes, my fence. It borders a driveway which passes through a reserve to get to the houses behind. I can assure you when it needs to be replaced my neighbours won't be coming to the party financially so they will not get a say.

New cable (even if its replacing the existing) they have to provide a new easement, so yes they can reject you

 

I could be wrong on this but didnt the government automatically pass a type of class easement where any telephone cables in place in 1987 automatically became an easement in favor of telecom when they sold it off? 

Then didnt they change the rules recently where any of these copper-to-fiber conversions were automatically classed as like-for-like?
