Basically what the topic says. We are getting fibre installed and everything is on the power lines with nothing under the shared driveway so when the fibre is installed aerially will I still need consent from the other owners who share the driveway?

Ah damn. We are hoping the answer will be no for us. Unfortunately no one could be home for the scope yesterday so waiting to hear back from the technician as downer said they didn't have that information.

It does seem unlikely that permission would be needed if it is just replacing the copper phone line that is already there.

Existing copper phone lines are covered by the Telecommunications Act  (when Telecom came into existance from the Post Office days) - new UFB conections are not - so : local authority ristrictions apply, pole ownership conditions apply, aerial trespass conditions could apply etc -

We have the same scenario for UFB installation, but Chorus required neighbors consent!

Hmmm I hear some of those new copper cables just happen to have a couple of strands of fibre in them too :)

What does your land title say as to who owns the drive? eg does your neighbour or you have an easement across the driveway, or is it equally owned?

Equally owned by three of us. I know one neighbour won't mind but the other place is a rental and the owner difficult to get a hold of and makes us go through the rental company to get a hold of him.

Will they need to dig the drive up, or is there an existing  conduit under it that they can thread it through? If they have to take it up, I imagine there will be a big cost involved in resealing it, and would that be shared 3 ways? I think you need a proper meeting with them, as there would also probably benefit from fibre, and they wouldn't want to take up the drive for each separate connection.

The Guy who came around to scope left a consent form for us in the mailbox which said that there will be no digging of the driveway which is why we assume it will be aerial as everything else goes to the house via powerpoles.

We have been waiting all day for the technician to call but I assume he is busy. I don't know why downer couldn't have the information for us.

I suspect the 'Downer' person who contacted you in the first place would be  a Service Agent from their Dispatch Center and wouldnt know what your actualy situation was - that is up to the Scoper.

I would suspect that if the Scoper left the concent forms in your mailbox, then you wernt home when he came to do the Scope.  If that is the case generaly he would/should have also left a card with the Dispacth Office Contact 0800number on it for YOU to ring them, not the other way around, so that arrangements can be made to pick the concent forms up Etc.

Yea that's exactly what happened. It was the contact office I spoke to today, which was the number that was left in the mailbox, and I asked them about consent and they said the scoper would know and that they would contact him to call me as I'm not allowed their number, which is fair enough. He didn't ring today so I'll call them again tomorrow to see what's happenin. He might have been sick!
